Riding on the back of a subway car is dangerous and the term "idiot" is definitely applicable to anyone who does it but "disgusting" seems a bit of a stretch.

And taking a peek in an unlocked cab is hardly a major offense— at least once, I discovered one of the partially dismantled cabs in the middle of a 5-car set had been left unlocked and since that was the only seat in the car, I took it.

There have been many claims of railfan rowdiness onboard the R-32 R train but no one has posted or linked to a first-hand account of the events, AFAIK. I'm not necessarily doubting the claims but people should be able to point to the source of the claims they are repeating.

Inanimate objects never gave me permission to do anything.

It was in a public place. It was unlocked. There was no obvious indication that it was off-limits. It was little more than a closet with a seat in it. I see nothing wrong with sitting in that seat.

Nilet, decades ago I was on a Philly Frankford line train at a place where the elevated runs next to a playground. A basketball came onto the structure's catwalk. The train stopped, then I saw our motorman on the catwalk toss the ball back to the playground, he walked back to the train, we started moving again. He had gone out of and back in through the cab window.

What I heard form the video was a bunch of very loud people. I can't ascertain from the video as to their body hygiene. If the smell was overbearing, I'd move to another car.
NYCTA has a wonderful subway system,I'm limited to very few lines with SEPTA.

An operator's cab is NOT a public place even if the door happens to be unlocked. If a person walks up to a private residence, finds the door unlocked and enters that individual is still guilty of the crime of "breaking and entering." Despite the door being unlocked anyone who enters is still guilty of unlawful entry!

An operator's cab is NOT a public place even if the door happens to be unlocked.

It wasn't an operator's cab. It was little more than a closet.

Apples to oranges. A private residence is unmistakably private. A subway car is not.

If you open a closet door in a public building, that's not unlawful entry.

If it was a "partially dismantled" cab, and the door to the actual T/O's controls was locked, then that portion of the cab with the seat in it was open to the public. I encountered a similar situation a few years ago on the Flushing Line and the T/O had the cab door closed over to the right hand corner but the rest of the cab was accessible to the public so I just walked up to the RFW and took advantage.

The "cab" I entered was in the middle of what's now a five-car set. The T/O's controls had been removed. The master controller was gone, and the brake valve had been capped. There was nothing left except the seat.

Although I did once get a RFW in a half-cab like you described too.

I though it was an unlocked cab of an R-188, but even so, there are certain circuit breakers and other switches in there that should be kept locked away from the general public.

They forgot to put that into the Rules of Conduct.

Agreed! It was not just the little miscreant riding on the outside of the train but the two other "railfans" for whom the event was apparently staged so they could shoot videos of it and then post it.

As discussed earlier this week, the other two railfans who you are referring to did not know that there was somebody surfing the rear of the train. In fact, they reported the incident to the T/O of the next train to arrive at the station.

The event was not staged, they just happened to be in the right place at the right time. Everyone else who was filming the R32 R along the 4th Avenue line on that trip down also ended up with the surprise of a train surfer showing up in their video.

Furthermore, in the video description of the posted video that depicts the surfer, the railfan who uploaded the video calls the surfer a "bimbo" and a "moron", hardly condoning the actions of the train surfer.
He did not realize the implications of posting the video, and once they were made clear, he took the video down.

The two railfans who filmed the train caught a lot of crap from uninformed folks who blindly accepted the notion that the event was staged, even though it was apparently their footage that allowed for the identification of the train surfer and the later issuance of a warrant for his arrest.

It really isn't fair that these two fans would be stigmatized for something they had no involvement with.

I was within the car body, and it was neither unauthorised nor illegal.

I never said I was special.

And declaring the War On Photography to be justified (either in general or in my specific case) is a hazardous thing for you to do— it's not so easy to jump back from Conclusions, so I hope you're a strong swimmer.

You are not entitled to a private area in a subway car. Your place is with everybody else, not inside a "closet" as you call it. You not knowing there are circuit breakers in a "closet" does not give you permission to be inside one.

This reminds me of a piece of certain dialogue in the 1974 film, The Taking of Pelham One Two Three:

Frank Correll: "Pelham One Two Three, what do you mean the train has been taken? Are you the motorman?

Mr. Blue: "Negative."

Frank Correll:"Well, then, who are you? Nobody's authorized to be in that cab, except the lousy motorman! Now identify yourself!"

Apart from a T/O who informed a friend of mine back in my high school days, a fictional film made that perfectly clear, and I have kept that in mind, since.

You can pick and choose any words you like. It doesn't change the fact that I did nothing wrong, nothing illegal, and nothing dangerous— and certainly nothing involving any graves, proverbial or otherwise.

I was riding in the same subway car as dozens of other people. There was one seat left, so I took it. That a train operator may have once sat in it in decades past, before the cars were converted into sets and the cab dismantled does not make it wrong or illegal. It was a public subway car on an in-service train, and there was no indication that seat was off limits.

That's borderline irrational. There is such thing called the "spirit of the law" you know. Just because it doesn't explicitly say it is illegal doesn't mean you should be allowed in there.

What about it don' t you agree with? The fact that he took the video down? He did so because he was pressured by others, not on his own accord.

I don't see any reason why I shouldn't be allowed to take the seat.

If you'd rather stand, you're free to.

The spirit of the law is to provide a safe orderly subway, and that's certainly not violated by my taking an unoccupied seat.
