An operator's cab is NOT a public place even if the door happens to be unlocked. If a person walks up to a private residence, finds the door unlocked and enters that individual is still guilty of the crime of "breaking and entering." Despite the door being unlocked anyone who enters is still guilty of unlawful entry! |
