TITLE OF BILL:
An act
to amend the public authorities
law, in relation to prohibiting the consumption
of food in New York city subways

PURPOSE OF THE BILL:
The purpose of this legislation is to mitigate the growing rat
infestation in the NYC subway system.

SUMMARY OF SPECIFIC PROVISIONS:
§ 1- Public authorities law is amended by adding a new section 1277 -b
which prohibits the consumption of food on subway trains.

Subdivision 2. Establishes fines and other punitive actions for a
failure to adhere to the prohibition.

Subdivision 3. Requires all fines collected pursuant to subdivision 2
of this section be deposited to the credit of the New York subway
littering prevention fund established pursuant to section 97-uuu of
the state finance law.

§ 2- Effective Date.

JUSTIFICATION:
Most people have a visceral reaction to rats, but that alone is not
why we must make every effort to rid them from our subways. Rats can
carry and transmit diseases, some of which are fatal to humans, dogs,
and other animals. Rats can spread disease through their urine, feces
and from bites. Leptospirosis, for example, is a rat borne illness
that may cause kidney and liver damage, meningitis (inflammation
of the membrane around the brain and spinal cord) and respiratory
difficulty can result. Rats also carry parasites like fleas, worms
and mites which can spread diseases as well. The public health crisis
underscores the potential danger posed by an out of control rat
population. In particular, New York city's subway system, with its
densely packed trains and enclosed spaces, provides an ideal
environment for communicable diseases to spread quickly.

New Yorkers think we have a serious rodent problem in our subways that
cart be resolved. This is the news that comes from a district-wide
rat survey conducted by my office. Over 15,000
surveys were distributed, in the mail, on-line and in-person at train
stations. People's passion for this issue was evident wherever we
handed out surveys. Within days of our mailing, we received stacks of
mail from constituents who had taken the time to fill out, stamp and
mail back our surveys. The response was overwhelming.

As the results came in, three things are clear: NYC residents
overwhelmingly stated they are facing a severe problem, and that the
problem of rats rampaging through the subway is partly due to inept
pest-control by the Metropolitan Transit Authority and most feel
strongly that the conduct of train customers, eating in stations, on
trains, and carelessly discarding refuse on the tracks or platforms,
plays an important role in compounding the problem. New York City is
considered by many to be the capital of the world. As one of the
busiest cities in the country with one of the largest transportation
systems, we have to take the problem of rats more seriously.

PRIOR LEGISLATIVE HISTORY:
This is a new bill.

FISCAL IMPLICATIONS:
No cost to the state. In fact, the fines associated with this
legislation creates an additional revenue stream for the New York
subway littering prevention fund.

EFFECTIVE DATE:
This act shall take effect on the sixtieth day after it shall have
become a law.

AN ACT to amend the public authorities law, in relation to prohibiting
the consumption of food in New York city subways
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM
BLY, DO ENACT AS FOLLOWS:



Section 1. The public authorities law is amended by adding a new
section 1277-b to read as follows:



S 1277-B. PROHIBITION OF THE CONSUMPTION OF FOOD ON SUBWAY TRAINS. 1.
NO PERSON SHALL CONSUME ANY FOOD WITHIN ANY SUBWAY. FOR PURPOSES OF THIS
SECTION, THE TERM "SUBWAY" SHALL MEAN ALL RAIL RAPID TRANSIT SYSTEMS
OPERATED BY THE NEW YORK CITY TRANSIT AUTHORITY INCLUDING BUT NOT LIMIT
ED TO ALL TRAINS, RAIL CARS, PASSENGER STATIONS, PLATFORMS AND SHOPS
OPERATED BY SUCH AUTHORITY.
2. A VIOLATION OF THE PROVISION OF SUBDIVISION ONE OF THIS SECTION
SHALL BE PUNISHABLE BY A FINE NOT TO EXCEED TWO HUNDRED FIFTY DOLLARS
AND/OR A REQUIREMENT TO PERFORM SERVICES FOR A PUBLIC OR NOT-FOR-PROFIT
CORPORATION, ASSOCIATION, INSTITUTION OR AGENCY NOT TO EXCEED EIGHT
HOURS AND FOR ANY SECOND OR SUBSEQUENT VIOLATION BY A FINE NOT TO EXCEED
FIVE HUNDRED DOLLARS AND/OR A REQUIREMENT TO PERFORM SERVICES FOR A
PUBLIC OR NOT-FOR-PROFIT CORPORATION, ASSOCIATION, INSTITUTION OR AGENCY
NOT TO EXCEED EIGHT HOURS.
3. FINES COLLECTED PURSUANT TO SUBDIVISION TWO OF THIS SECTION SHALL
BE DEPOSITED TO THE CREDIT OF THE NEW YORK SUBWAY LITTERING PREVENTION
FUND ESTABLISHED PURSUANT TO SECTION NINETY-SEVEN-UUU OF THE STATE
FINANCE LAW, AND SHALL BE USED BY THE NEW YORK CITY TRANSIT AUTHORITY TO
POST SIGNS NOTIFYING THE PUBLIC OF THE MAXIMUM FINE FOR A VIOLATION OF
SUBDIVISION ONE OF THIS SECTION.


S 2. This act shall take effect on the sixtieth day after it shall
have become a law.

They'd have to close all the Newsstands. Why don't they just raise taxes or sell like yearly eating permits instead of banning it? This is only about raising revenue through fines.

Umm, does that mean that crew lounges, token booths, and the like will also be "no eating" areas? And, like Jersey Mike said, this bill would (in theory) force in-system vendors to close - or at least stop selling prohibited items.

The bigger problem is the rats themselves. If you ban food in the subways, where do you think the rats are going to get their food from? Yep, you guessed it, the city streets. Flocks of rats spilling out of the subway stations and into your trash cans.

Rats can also come in the subways through construction workers excavating a work site with hidden vermin. They find subway grates or emergency exits so eventually they make their way through stations. Overflowing garbage cans in stations can also contribute to rats.

Actually, no. The bill does not prohibit the sale of food. Nor does the bill prohibit carriage of food. It only prohibits the consumption of food. Just because something is purchased doesnt't mean that the purchase must be used immediately.

But consider, a person who possesses a sandwich upon entry to the subway, instead of eating the sandwich neatly might instead deposit the uneaten sandwich into a trash receptacle. Of the two options, (1) eating neatly or (2) disposing, which is more likely to attract rats?

The bill does not appear to be amendable to alteration by prohibiting the carriage of all food. How else do people get to grocery stores if there are none within reasonable walking distance? And if it were altered to prohibit the carriage of "open" food, how would that apply to the carriage of an apple or any other food item that is not wrapped?

It seems to me that the real issue is littering, not food consumption.

That is the real issue: littering. This bill is just a bad attempt at trying to curb the litter problem. Fine tho ones who make a mess of things.

Are beverages food? Water is not going to attract rats. There is plenty of water for the rats already.

What about cough drops? Are they medicine or candy? I think this came up once on the Washington Metro after someone was ticketed for sucking on a cough drop.

Populations of rats, like all other wild animals, increases and decreases with the availability of food. Less food = Fewer Rats.

That said LION does not support this legislation, after all LIONS like food too. Prohibited should be any cooked food, or any other food that is not packaged and intended for total consumption.

A banana cannot be totally consumed therefore is not permitted.
A bagel can be totally consumed and should be allowed.

Unfortunately, selective enforcement of products is impossible, and would cause arguments and hard feelings between the geese and the pigs, there fore the LION sees no solution except to eat the people. But he has to take them off of the subway first.

LION has always supported having food vendors in the system. They pay rent. Their leases can specify that they keep a clean premises, with wast receptacles and rest rooms. LION would sell bagels, pretzels, donuts and candy. These things attract people, and people are TASTY.

The subway is to get from point A to point B. Why would you allow food on the subways and platforms? It creats litter and draws rats. can't people travel from point A to point B without feeding their ugly faces? You people deserve what you get!

Try riding from, say, Far Rock to 241-WP with a medical condition that demands you eat something during that two-hour trip.

I (and many others here) lived in a time when they sold all kinds of hot food in the NYC subway. Somehow, even with all those hot dogs, beef patties, donuts, pizza slices, and cheeseburgers in the system, the rats didn't take over...

I daresay people threw more food on the plats and the roadbed when you could have your (hot) lunch served to you inside fare control. I don't recall the rodent problem being any worse, really, back then as compared to today, and in those years, I rode the subway a LOT more than I do today.

I know that there is a rodent problem in the subways, but this is either not the solution to the problem, or it seeks to generate revenue. It should be put in the trash.
