There is no officer's side in this - they issued a ticket for illegal photography when photography is clearly legal. How do you defend that?

I now think the cops know the law and really don't care.

I think they have been given instructions from their superiors to harass photographers in spite of the law. Either way it is inexcusable.

A lot of street photographers carry business cards that threaten to sue under TITLE 42 CHAPTER 21 SUBCHAPTER I § 1983 if their photography is interfered with in any way.

Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer’s judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia.

Not just the NYPD but the individual officers as well. Maybe when the individual officers see their pay garnisheed from their paychecks in the amount allowed by statute they won't be so quick to make up their own laws. Also, keep in mind that since the trials of the Nazi war criminals, "following orders" when the individual either could or should know what is legally and morally right is not a viable defense for inappropriate actions.

Thanks, No - a $5 million hole in the NYPD budget just gets made up by either more taxes or less money going to other city departments. The judgments need to be against the individual officers.

I hope this costs the taxpayers a TON of money. Everyone with a brain knows that 9-11 was an inside job committed by the GOP in cooperation with their Al Qaeda partners to destroy the post Watergate bans on information sharing. We need to turn the clock back to 9-10 but with a ban on the Republican Party, Reagan Worship and supply side ideology. The GOP did it, Destroy them and the problem goes away. Kudos to the brave heroes of the ACLU, Hopefully they can get a couple pigs fired.

1. Obviously they don't want to understand them

2. In NY you do not have to show ID - you only have to provide identifying information

§ 140.50 Temporary questioning of persons in public places; search for weapons.
1. In addition to the authority provided by this article for making an arrest without a warrant, a police officer may stop a person in a public place located within the geographical area of such officer's employment when he reasonably suspects that such person is committing, has committed or is about to commit either (a) a felony or (b) a misdemeanor defined in the penal law, and may demand of him his name, address and an explanation of his conduct.


Since photography is not a crime why do the cops need to ask for ID?

Also in this case it really did not matter - the cops were insisting that photography was illegal. Showing ID would not have changed that - a once a year photo opportunity to take pictures of the museum train was ruined

I watch at least some part (15-30 minutes) of the local news nearly every day. It's one of the few things that I like on TV. It's not like you're necessarily missing anything by not watching it, but there are probably millions of people in the NYC area that watch.

there is no "two sides to the story" here.
the officers in question know the rules just as well as we do..
the fact that they CITED THE RULES THAT SUPPORT PICTURE TAKING clearly makes them either IDIOTS or QUOTA CATCHERS...

Neither is an excuse for their behavior...the fact that it was thrown out of that "GUILTY UNTILL PROVEN INNOCENT KANGAROO COURT" proves it..

let THEM pay the suit..not the tax payers.

Pleased to see Carlos Miller's website has picked up the story. What is needed is full-blown national media coverage, i.e., TV, radio, newspapers.

These types of incidents will continue as long as Homeland Security Chief, Janet Napolitano's war on photography, which she perceives as suspicious behavior, persists.

The Transit Museum and the MTA need to step up to the plate on this one too. "Railfan and Railroad" could have been writing a positive article that might have attracted railfans from across the country to visit the Museum and/or ride the historic trains. Instead the message will be visit to take pictures at the risk of being arrested and subjected to months of legal problems.

Good that this gets media attention!! But sadly, whether it will stop, indeed will remain to be seen!!! I mean if RType's publicized issue didn't slow things down or stop them, I would not, sadly, hold my breath on this one stopping anything!!

I have taken pictures in front of cops and never had a problem with them.

No, wait. I had one problem. In 2004, during the Centennial celebration on the Astoria line. NP David was with me at the time, so he should recall the incident.
