This is inexcusable. How many lawsuits will it take before the NYPD ends its war against photography. This cannot simply be attributed to police officers who are "ignorant" of the law

I got an email regarding the story; you beat me to posting it......
pretty despicable if u ask me.......I hope these guys get a nice payout.......
I'm surprised that they didn't tell their story sooner......
Also, they should call the news; let our taxpaying new yorkers see that their money is being wasted by having nypd cops (who clearly must not be able to comprehend english) writing bogus tickets and taking guys in who clearly did nothing wrong........
I'm waiting to see if someone here says they provoked the cops.....smdh.....

LION has NEVER been approached by a "bad guy"

LION has been questioned by officers with the result being "Have a nice day, and enjoy your stay in New York City."

LION does not get puffy with the cops. He breaks out his brochures about his railroad, and after a few minutes of detailed explanations on my railroad, the officers are quite happy to get away.

Steve will prevail. But this thing happens over and over and over. And it will continue.

Steve prevailing WILL NOT set a new policy for NYPD to stop hassling the public for legal photography in the subway. King Bloomburg and his faithful "deputy" Ray Kelly won't do it as they'll stick up for every cop who does this claiming it's a "judgement call, erring on the side of caution i.e possible terrorist connections, you see, Steve Barry got it thrown out anyway."

NYPD message to railfans: maybe photography is legal, but we'll hassle you to death to discourage you from partaking in your legal hobby.

Having 1 cop screw up is bad enough, but 5 is beyond stupid.

It's fairly indicative of a willful disregard for the law. The court should award damages of $1 million against the NYPD for each officer involved. A $5 million hole in their budget would serve them right. They'd have to follow the TWU's example and remortgage their headquarters and start behaving for the next 20 years.

Eventually,with a lot of payouts on cops judgment calls(which are wrong),they are going to cost the city money......someone is going to get a nice payout eventually if this continues........
Also, if the c.c.r.b finds the cops acted inappropriately,there is a penalty,from loss of vacation days to a suspension.......
In my instance, the cops were found to have acted inappropriately(I don't know what penalty they ended up getting)......

SMDH. He was making a comparison. He's not saying the TWU acted like these cops. He's comparing the punishment the TWU received, and their resulting financial hardship, with what he thinks the NYPD deserves.

This is like your "appeal to majority" incident. Both times you totally didn't understand what was being said. Please try to listen to reason instead of lashing out and arguing.

No, Bill. That explanation would only make sense if they were defending an incident where someone was detained but ultimately not charged with anything. That is not the case here, so that is not what "King Bloomburg and his faithful "deputy" Ray Kelly" would say in this case. There is absolutely no defense possible that "King Bloomburg and his faithful "deputy" Ray Kelly" could use for the actions of these officers in charging Steve with a violation of 1050.9c when the law is the opposite of what the cops meant to charge him with.

Those officers and the City get what they deserve and I hope this guy and anyone else with him win and win big!!! Those officers could not have been more wrong!!

Again, the last several times I was at Broad Channel to take shots, and there was nothing in particular running the times I went, and stayed each time there at least 2 hours or so, and the NYPD never said a word to me (and so it is clear, I DO NOT carry my railroad I.D. on my person!!), and in fact one time they were there when I was shooting, I even stopped them and asked them about the photography thing, and all 5 officers confirmed to me that system photography is perfectly legal providing it is done in legal, public areas and not in restricted areas (aka trespassing). I shot away for a whole 2 1/2 hours there after and nothing happened at all. But they did go on to say, and I state I am not saying at all this guy or his companions did this, but the times they do speak to rail buffs and photographers, issues arise when the buffs or photographers begin getting belligerent with them, and combatant with them, and then they do what they have to do given that escalated situation.

Much we know from the story, but do remember there are accounts of this we do not know about, and there are other sides of this story. Let us see where this goes, and what more comes out, and then make judgments.

Only 50K. I'd sue for 50 million, not to actually win, but to gain publicity and to make whatever settlement high enough to warrant actual action being taken on this issue. I now think the cops know the law and really don't care.

Well, the hope is that from this they get the $$$$$$ and use it to get even better cameras and equipment, and keep on doing what they do.

Just sad that a few misinformed officers had to spoil things!!! smh....sigh!!

But again, let us get the whole story and then make judgments. There is the editor's side, but there is also the officer's sides to that should be heard. And if I recall Broad Channel has cameras, so maybe the cameras can be key to corroborating someone's account here.

Sad to say I have seen a fair bit of power-tripped officers, and I mean the kind who should not have their jobs, and to be honest I have found some NYPD guys to be horribly arrogant, even ones who come on our trains with courtesy rides.....often, I have to tell them "You're welcome" when the least they can do is say thanks, as MNR nor LIRR conductors and crew are NOT required, even with the MTA Police Ride Pass the officers are issued, to ride them, as it rests solely in our judgment. Some are really arrogant bastards, and when on duty can very easily translate into being power-hungry imbeciles.

Which is totally irrelevant to this thread, because even if the railfans did get belligerent, the cops wouldn't charge them with violating a non-existent law!

There is no officer's side. When are you going to understand that? There is never any justification to charge someone with a violation of a non-existent law. You are clearly confusing this incident with one where the officers charge someone with the violation of an EXISTING law.

There is no officer's side in this - they issued a ticket for illegal photography when photography is clearly legal. How do you defend that?
