Administrative adjudication is to collect fines, not find you not guilty. In another thread here, it was pointed out that Admin Law Judges (especially those who work part-time) are "motivated", by management, to have high conviction rates, because the city needs the money.The Constitution does not apply in Administrative hearings (or IRS Tax Court, either. The burden of proof in Tax Court is on the defense.) |
