Very similar to the firefighters story where they let a house burn, but in this case, a lifeguard did the wrong thing and responded outside his coverage area.

The lifeguard was not responsible for that area. He was supposed to patrol a certain area and by leaving it, put his area at risk. Now that lifeguard station will be responsible for all drowning victims outside their coverage area. They bought it.

He was supposed to call 911.

Did you know you can go to jail for swimming at NYC beaches after 6pm? NYPD will cuff you and take you to jail if you don't get out of the water.

It's because of people like this man who nearly drowned, that the next phase will be to simply ban swimming when no guards are on duty. Those who dare enter will go to jail.

Bullshit. The man would have drowned and you have the ability to save him; what do you do? There are lots of others that could have called 911, including the man that told the lifeguard what was going on.

The kid was on duty and responsible for a certain area. The nurse who volunteered did the right thing. The lifeguard should have stayed at his post. That's his job. Covering the neighboring SWIM AT YOUR OWN RISK beach is not his job.


But don't worry, eventually all beaches will be like NYC where you go to jail for swimming when lifeguards are off duty. That's the only way to settle this shit.

The employer can't overlook it. If this lifeguard got hurt or the victim didn't survive, he could cause a world of problems for his employer. He basically made his employer responsible for a portion of beach that has SWIM AT YOUR OWN RISK signage.

If the lifeguard is supposed to cover a certain area and left it to cover another beach, he's wrong.

I get the whole liability thing, but this is ridiculous to say that this trained lifeguard should simply call 911 because of a boundary. That person almost certainly would've drowned had the lifeguard followed (the insane) policy.

Kudos to the young man for following his basic human instinct.

I think the problem is more that he would neglect his assigned area to take time to save the guy in the unassigned "swim at your own risk" area.

Joe V said it best. What if someone drowned in his assigned area while he was off saving someone else?

Yes, that is a very valid case, but I am glad that this guy went with his basic moral judgement instead of simply worrying about covering his own ass.

I think termination was way too excessive, but if I were in his position I'd feel better about helping to save someone's life than to be comfy in my job knowing that I could've saved a life but did not if, heaven forbid, the person didn't make it.

Yup, in a country where lawsuits rule, that would be the correct procedure.

And people wonder why there are so many people out there that are just flat out apathetic to anyone, especially helping others. The lifeguard made the right choice that he can live with, even if it ended up sacrificing his current position.

I agree and thought about that too after I had posted. Definitely valid points but I hate to hear of things like this. Of course I think we'd all hate to hear about if the lifeguard hadn't acted and the person drowned and/or if someone in the lifeguard's assigned area was in distress while he was in the unauthorized area.

My brother drowned less than 2 weeks ago. Two men tried to save him but it was too late. This is sick to fire someone for trying to save somebody. Rules, give me a break sometimes rules just get in the way of common sense.

It's lunacy to expect a lifeguard to patrol a defined section of beach and not the entire Atlantic Oceanfront? He put lives at risk by leaving his job and going to a beach he doesn't work at.

The person in the water disobeyed signage. He took a big risk going in the water where guards aren't on duty. That's life.

Firing him is the right thing to do. Otherwise, these lifeguards will continue to respond to calls outside their coverage area. This puts more lives at risk.

If it did, I would understand. I do swim in Sarasota sometimes. There is a private pool right on the boardwalk by the Gulf. The lifeguards who work there can not leave that pool to save someone drowning at the beach. It's easy to understand. Don't swim where there are no lifeguards.

A Florida lifeguard who was fired after leaving his beach zone to save a drowning man has been offered his job back.

Tomas Lopez, 21, who was sacked by employer Jeff Ellis & Associates after his heroics Monday at Hallendale Beach, 18 miles north of Miami, should never have been fired, Jeff Ellis told the Sun-Sentinel Thursday.

"I am of the opinion that the supervisors acted hastily, " Ellis said. "It was not the appropriate course of action to take," he said.

The fate of nine other lifeguards, who either quit in solidarity or were fired for stating publicly that they would also do as Lopez did, is not clear.

I would understand the SWIM AT OWN RISK signs and would not assume that a lifeguard employed at another beach or nearby pool is obligated to rescue me.

He wasn't "patrolling". It was seen someone was in danger of drowning.
It's irrelevant if the other guy was doing it "at his own risk".

The lifeguard has a job at a certain beach paid for by a certain employer. He can't abandon his job and go to another beach to conduct rescue missions. On his own time he can.
