It was on March 14, 2010 that a male voice announced, “Attention Walmart customers: All black people must leave the store.” A manager quickly made his own announcement, apologizing for the message, and it was subsequently discovered that a 16-year-old had made the broadcast. The teenager was charged with harassment and bias intimidation, but now Donnell Battie, who is black, is suing Walmart claiming the store was negligent and reckless and showed deliberate indifference by not keeping the P.A. system safe from abuse, according to the New Jersey Law Journal. |

They happened to be having a flea market and when I drove by there were about 30 or 40 bikes chained to the gate outside. They were owned by the hippie population that is taking over that stretch of Bushwick/Lower Ridgewood/East Williamsburg. It was a fun day. |

It could be "deep pockets" syndrome or it could be "lawyer wanting to make a name for himself" syndrome.The article doesn't say what the damages being pursued are, and it is hard to imagine what Mr. Battie could actually claim his damages were. From the little information that is given, this has all the makings of a guilty verdict with a judgment of $1 (or even zero) to the plaintiff. |

Yup.Clicking through some of the links in the original link can get you to a copy of the actual lawsuit. He is apparently suing for $1 Million, claiming that he suffered "severe and disabling emotional and psychological harm, resulting in depression, anxiety, anger, loss of sleep, loss of appetite, paranoia, anti-social tendencies, and loss of enjoyment in life activities."
