That was when they lost the dues "check-off" after the last strike. Many people just never paid their dues voluntarily. When the TWU got the dues check-off back there were many who didn't pay the dues that were owed. Many of those were people who also frequently ran afoul of management. The TWU was still obligated to represent them in the disciplinary process but it seemed to me that for those who were significantly behind in their dues, the representation at hearings was somewhat less than stellar. |

Tri-partite arbitration is an interesting process. Since the arbitrator is paid jointly by labor and management, (and since the arbitrator wants to be called back at $1500 per day) he or she will often split the decisions, giving the union half and management half of the day's decisions. It is more about how seriously each case is viewed by the respective sides. If the TWU wants to save "Jones", then Jackson may have to lose his case. It is what it is. Hence a person who is delinquent in his or her dues may be one of those sacrificed for someone who is current. |

Before New Directions got in and fired most of the arbitrators, TA was winning way more than half. It was a normal affair seeing someone lose a case with clear cut contract language in his/her favor. Firing the existing ones helped make the system fairer for the innocent today even though TA retaliated by writing more DANS. I think Adelman was one of the ones kept behind, and IIRC he ruled against OPTO on the L line, one of the best and safer decisions (in agreement with system safety) made since I left |
