Tri-partite arbitration is an interesting process. Since the arbitrator is paid jointly by labor and management, (and since the arbitrator wants to be called back at $1500 per day) he or she will often split the decisions, giving the union half and management half of the day's decisions. It is more about how seriously each case is viewed by the respective sides. If the TWU wants to save "Jones", then Jackson may have to lose his case. It is what it is. Hence a person who is delinquent in his or her dues may be one of those sacrificed for someone who is current.
