TSA Warns Travelers May Be Arrested, Detained, and Fined for Refusing Search

In response to growing outrage over naked body scanners and intrusive pat down searches of the private parts of air travelers, the TSA is warning Americans that they may be arrested and fined $11,000 if they refuse to cooperate with the agency’s invasive and humiliating techniques.

The TSA warns that any “would-be commercial airline passenger” who enters an airport checkpoint and refuses to be subjected to “the method of inspection designated by the TSA will not be allowed to fly and also will not be permitted to simply leave the airport” (emphasis added).

The TSA will work with local police in order to make sure the person remains on the premises and answers questions. “Anyone refusing faces fines up to $11,000 and possible arrest,” reports the Palm Beach Post.

“Once a person submits to the screening process, they can not just decide to leave that process,” Sari Koshetz, regional TSA spokesperson, told the Florida newspaper. The policy includes people who decide not to fly.

Teri Barbera, a spokesperson for the Palm Beach Sheriff’s office, said local police would assist the TSA in preventing people from leaving the airport. “We will handle each incident on a case-by-case basis,” said Barbera. “The deputies will do it at the airport just as they would do it anywhere else.”

On Wednesday, TSA boss John S. Pistole testified before Congress on the controversy brewing over the fact airports have become areas where the Bill of Rights no longer applies. Pistole said the TSA will enforce the new policies despite complaints that the search methods are too invasive and a violation of the Fourth Amendment.

Senator John Ensign, a Nevada Republican, asked Pistole about groups that objected to all forms of bodily search on religious grounds. “While we respect that person’s beliefs, that person’s not going to get on an airplane,” said the TSA boss.

Now the TSA has announced it will also enlist local police to detain people who refuse body scans.

In addition to not being permitted to board a commercial plane, they will also be interrogated by agents of the federal government. If not cleared by government bureaucrats, they will presumably be arrested and charged with a crime and fined $11,000.

Prove me wrong. The majority of domestic terrorism incidents have been related to reproductive rights....over 200 incidents....all of which are perpetrated by RWers. Then there's Oklahoma City, which we all know was a RW thing.

Since 1980, there have been 3 ecological incidents, which were actually targeted arsons. There have been several international incidents, the Times Square smoker (a US citizen trained for terror in Pakistan) , the 2 attempted plane bombers, and WTC 1993 and 9/11. Those do not count as domestic in origin.

The TSA says that he was "escorted from the screening area by local law enforcement", and the agency denies he was detained, but nowhere in the article does it suggest he was free to leave. He was later "rescreened", which the TSA agents could have done in the first place, instead of "holding" him for refusing a further search.

Locking a cockpit door doesn't prevent an explosive-laden suicide bomber like a Richard Reid or the Underwear Guy.

Bringing down a single plane and all its occupants was a calculable risk that governments, airline companies and their bankers and passengers were willing to take; e.g. Lockerbie. What 9/11 taught was that bringing down a single plane was able to take more lives and property than just the plane. That cost was incalculable and needed to be addressed. Closing the cockpit door essentially eliminated that risk. The rest of the airline boarding routine is fluff.

There were skyjackings long before 0/11, and we did just fine at securing aircraft for decades before 2001.

No hijackers tried flying the planes themselves prior to 9/11, nor did they try flying a plane into a building before then. It probably should have been expected that at some point someone would try it, and counterterrorism experts said so, but the governments and airlines didn't really train for such a possibility as far as I know. Now that it has been done, it probably won't be tried again, since the passengers will fight back.

There has to be a better way to do airline security...how about not letting suspected terrorists get NEAR the airport in the first place?

Take a field trip to Ben Gurion Airport in Tel Aviv. Lots of insight on how to do security right here, here, and here.

And, now, we come back to the first point in your post:

While I agree with you that strict airport security is a necessary evil of our time

It always has been, but no one wanted to deal with it until 9/12/01.

American government employees within the US don't have sovereign immunity.

They have qualified immunity.

OK, I hadn't seen that before.

Patently unconstitutional, but I guess it will have to go up to the Supreme Court to get resolved.

Someone is going to have to refuse, be detained, ask if they are under arrest and if so what is the charge. If not told they are under arrest, they need to say well then I'd like to leave. If under arrest, then they need to dispute the charge.
