It sounds like 8-1 in favor of birthright citizenship for residents. 4 Justices seem open to restricting birth tourism.

Birth tourists are likely to be the upper classes of their societies, and may therefore be a more desirable citizen than the stereotypical “anchor baby.”

It's probobly not a problem if they end up living here but it could be a problem if we end up with a large number US citizens living in China voting by mail with the Chinese government inspecting their ballots before they are submitted. At the very least voting from authoritarian countries should be done in person at a consulate rather than by mail.

I haven't read the opinion, so I don't know, but I agree with you. Assuming, of course, that you define "anchor baby" as the children of tourists, illegals or other "transients" and not the children of permanent residents (green card) or similar.

My rules on voting would apply to everyone but in practice the Chinese government taking action against an American raised person with American family and friends would get more attention than someone raised in China with Chinese family who has never lived in this country.

There is a 30 day state residency requirement for voting. Birthright citizens have to establish a residence within a state before being allowed to cast a vote. That's difficult to do, if their permanent residence is abroad.

The decision was pro-American. It upheld the plain meaning of the Constitution against an unlawful executive order.

My country derives its existence and justification from the Constitution and from nothing else. Without it, it does not exist.

Liberals like Roberts, Barrett, and Kavanagh?

Why am I asking? Of course you consider them liberals.

Why would you accuse the liberals of wanting the civil war when its the conservatives who kicked the hornets' nest and decided to reinterpret over a century and a half of law and jurisprudence on a minor issue related to immigration? Changing birthright citizenship won't prevent immigration, which is the thing you actually oppose.

It's like voter ID. It's a solution in search of a problem that nevertheless placates people.

The anchor baby problem goes away if illegal immigration is eliminated. Elsewhere in this thread I pointed out that "birth tourism" may actually be beneficial as it selects for high income people.

The 14th Amendment provides the fundamental protection for a racial minority. Repeal the 14th Amendment and it stops becoming clear that the Civil Rights Act of 1964 is constitutional.

It's a solution in search of a problem that nevertheless placates people.

It also hurts people. Huge numbers of people with US birth certificates will need to prove their citizenship. Significant numbers could be wrongfully denied citizenship, say if the father was a permanent resident but walked out on the family when the kid was young.

And by the way, do you want to deny citizenship to the children of people who are legally in the country for more than a time-limited visit by authority of an Act of Congress but not permanent residents? There are lots of such people.
