It’s not odd, it’s paternalistic. They think that women are victims of abortion, that they lack sufficient agency to decide to do something so “monstrous.” Not everyone believes this, but this is the even jellicle narrative.

I actually think they say they don't want women jailed for having an abortion because if they said they did want them jailed, support for a ban on abortion would sink to the sub-basement.

They may or may not be human beings, but they're definitely something more than an appendix of the mother, to be disposed of without any moral quandary. This is not necessarily a religiously-based approach - it can be based on secular humanism as well. As such, there is a definite secular interest in preserving this potential human, though of course people can reasonably disagree on how to balance that interest with the rights of the mother


So - one person may favor blue laws to give workers a day off and another may favor them to rest on "the Lord's day" - but the blue laws are still constitutional. Similarly, one person may want to limit abortion based on a secular humanistic interest in the life of the fetus while another wants to limit it because they believe that that is the will of their chosen dirty - but that, too, has no impact on such a law's constitutionality.

That’s where we disagree though. I don’t think an appendix is exactly analogous, but at least in the early period it should not be subject to protection against its own possible future mother. If you extend the logic of “potential human” far enough back, you can ban contraception too (some people will say masturbation, but that’s a reductio ad absurdum if there ever was).

The blue laws are constitutional even if the day off happens to be on Sunday simply because it’s the one that more people would want to choose anyway. It’s like closing government offices on Christmas, otherwise a non-secular holiday. It would be wrong if the government enacted or amended the law today and still called it “the Lord’s Day.”

So you are calling it a fetus. I agree that there is a legitimate secular interest in protecting a fetus.

I'm not sure that we've concluded that we disagree on whether, as a matter of policy, abortion should or should not be allowed and at what point - I've been careful not to take a position on that in this discussion. The sole points I'm making are that there is a civil government interest in whether and when abortion should be allowed, and that there's no constitutional bar to government passing laws in accordance with that interest.

Once those two points are established, government may decide to allow abortion on terms similar or even more lenient than those in place today, or to restrict it still further - reasonable people can disagree on what should be the case based on any number of factors, and whatever my personal view is on this point has nothing to do with the two primary points I made.

Does that make sense to you?

All this does is return abortion regulation back to the states. In the bluest states, abortion will still be legal. I'm guessing in New York abortions will still be available.

Hasn't happened yet, but if it does, so what? I can't see why so many are getting their panties in a knot. It will then be up to each state and most will allow the procedure. Even NYS already said nothing will change here. Even out of staters will be allowed to get one w/o any residency requirements.
