Lisa Montgomery Will Not Be Executed Today
Posted by Train Dude on Tue Jan 12 10:59:20 2021 A federal judge in Indiana has issued a stay in her case so that the court can hear arguments on whether she is competent enough to be executed. Ms. Montgomery was convicted in 2004 of a particularly brutal murder by strangling a pregnant woman, cutting out her baby and trying to pass it off as her own. So now, not being a lawyer i don't understand this but, she was found competent to stand trial. Is there a different standard of competence to be executed? What is that measure of competence?

I believe permanent, irreversible punishment can only be meted out by a perfect justice system, i.e. one that makes no error in sending someone to be executed. The long history of capital punishment in the United States is rife with examples of innocent people who have been wrongly executed by the state.

Your argument perhaps advances the idea that capital punishment ought to be more rare, something that I agree with, although I also generally oppose capital punishment.

Someone develops dementia they may have been competent at the time of trial but are no longer that way.

Quarterman, the most recent major case on this issue, the death penalty is not allowed where “the prisoner’s mental state is so distorted by a mental illness that his awareness of the crime and punishment has little or no relation to the understanding of those concepts shared by the community as a whole.” This is measured at the time the person is scheduled to die because certain medical conditions can occur in between the time of trial and the time the death penalty is carried out which leads to due process questions if you based it on some prior time.

I do not agree with how long it takes to implement the death penalty, but when the Supreme Court has spoken only the Supreme Court can reverse (I can advocate for why I believe they should reverse, but that does not mean I can state that the law is different).
