Quarterman, the most recent major case on this issue, the death penalty is not allowed where “the prisoner’s mental state is so distorted by a mental illness that his awareness of the crime and punishment has little or no relation to the understanding of those concepts shared by the community as a whole.”This is measured at the time the person is scheduled to die because certain medical conditions can occur in between the time of trial and the time the death penalty is carried out which leads to due process questions if you based it on some prior time. |
