My Take On The Possible Supreme Court Nomination

When Then President obama nonnominated Merrick Garland to replace the late Antonin Scalia on the Supreme court, Mitch McConnell said, would not consider any nominee put forth by Obama, and that a Supreme Court nomination should be left to the next President of the United States. That was in February 2016. At that time I agreed with McConnell. Now he wants to do the opposite. I also think it is too close the election. What makes McConnell feel that the democrats can't do it, but the Republicans can. McConnell and any other Senate Republican who entertains a Supreme Court nominee is a hypocrite.

The sad thing is....and this has been a while now...probably since Thomas and more.... And has gotten way worse (the kavanaugh spectacle was an atrocity)
The Republicans will never supports democrat appointment, and the Democrats will never support a Republican appointment. And that is unfortunate, as it's supposed to be bipartisan

Maybe if both parties weren't hell bent on ideologues who can hold a seat for 40 years. Neither Trump nor Biden want Justices who will uphold the Constitution. They want a particular outcome in certain types of cases and don't care what needs to be twisted to reach that result.

If anything this scenario is more extreme than 4 years ago. Had RBG died in February, a new nominee could have been exercising his/her duties prior to the end of the presidency. As is, even if someone was nominated this week, it is unlikely that the person would actually be on the Supreme Court until after January 20.

I didn't want to go too far into the distant past. My point is that even post-Bork, Democrats have been quite supportive of many Republican nominees.

According to wiki a republican controlled senate hasn't confirmed a democratic nominee since 1895. Garland was their first chance since then, so it doesn't happen often.

Democratics over that same period have rejected three and approved 12 Republican nominations.

People can blame all they want to get this point, but I believe the Democrats opened the road to this in November 2013 when they had the power to open the door to the nuclear option in the senate. THEY took away the 2/3 majority and made it a simple majority for all nominations (except supreme court). That was a mistake in my opinion.
The Republicans threw the final nail in in 2017 with adding SC nomi actions.

So here we are. The democrats didn't bring us here....the Republicans didn't bring us here....they both did, operating in their own best interests got us to this point.

I highly doubt that McConnell wouldn’t have eliminated the nuclear option, so it doesn’t matter who did it.

I disagree. Clark wasn’t a conservative and appointing Marshall didn’t change the Court’s makeup. It was similar to Goldberg being replaced by Fortas.

Wait! Where is it written in the constitution that in the last 4 months of a president's term in office, he/she relinquishes some of the presidential authority that comes with title? I can't find it anywhere. If we are a nation of laws, lets follow the law.
