How Trump May Be Violating Federal Law

Recently, Trump began "cracking down" on those immigrants seeking asylum in the United States. He even dangled a pardon in front of his CBP commissioner, should he be jailed for refusing to admit asylum seekers into the country.

The actual law governing political asylum in the United States is fairly liberal:


8 U.S. Code 1158.

"(a) Authority to apply for asylum
(1) In general
Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title."

So why is Trump flouting its provisions, when a prerequisite for asylum is being physically present in the US?

Key is “may apply for asylum.” That does not mean they have to be granted asylum and the United States is well within its rights to limit the granting of asylum.

You really need to learn how to read. MTK got it wrong and you just paraphrased his post and got it wrong too.
Nobody is saying that anybody is entitled to asylum but they are entitled to enter the United States to apply

Chris obviously has it totally wrong but I'm not sure you have it completely right either.

They are entitled to apply if they are within the United States. I am not sure they are entitled to enter the United States in order to apply. If they come up to a valid border station, my understanding is that they must be allowed to apply but need not be allowed to enter.

I may not have it quite right either, however.

Not only are asylum applicants permitted to be in the US, they have up to one year to apply for asylum status once here.

The law states that application may be made for asylum once the petitioner is in the US, regardless of the manner in which they arrived, including over the oceans.

That strongly suggests that admission for the purpose of seeking asylum cannot be refused.

That strongly suggests that admission for the purpose of seeking asylum cannot be refused.

Why?

So it says, if you're in the US, you can apply for asylum. That doesn't say we must let you into the US to apply for asylum.

Canada, for instance, does not allow that. If you go up to a border station and say I want to apply for asylum, they don't let you in and don't let you apply. But if you sneak over the border and wave down a cop and say I want to apply for asylum, they let you apply.

Because the statute does not say that the applicant must be admitted to the United States pending processing of the application. In fact, immigration authorities are permitted to detain such applicant until such time as the application is properly heard.

A person seeking asylum need not be in the US. They can apply at a port of entry.

Based on my reading of 8 U.S.C. §1158 and related statutes there is nothing that prohibits the United States from refusing entry to those who are only seeking entry for purpose of applying for asylum

I don't get that. If you sneak over the border, you have broken the law.
So if you go up to a cop (in Canada) and ask for asylum, and the cop knowing that you've broken the law already, since you are already there,
they let you apply for asylum being a known lawbreaker?
What am I missing?

Umm, I think its this, correct me if I'm wrong... the protection granted by a nation to someone who has left their native country as a political refugee.

That said, In the Canadian example previously posted, why do you have to sneak over the border to get asylum but just walking up to the border asking for asylum you'll get turned away?

I don't know, nor care about Canada.

In America, you can walk up to the border at an official crossing and request asylum and your application is honored (may be eventually rejected anyway). You can also apply if you've already crossed the border, legally or otherwise.

It reminds me of the James Bond movies or the Batman series, where everyone keeps on trying to come up with imagine two ways to kill them, except in the end it never works. If they had just shot Batman and Robin and James Bond in the head, they would be gone. If you just vote Trump out of office, he will be gone!
