Travel ban is not the best test as there is legitimate disagreement among constitutional scholars (and not just those who always come down on particular sides of cases, I am talking about scholars who thought travel ban and Affordable Care Act were both unconstitutional). Better argument about Sotomayor substituting her policy preferences can be seen in her dissents from denial of cert on death penalty cases and dissents in opinions like Streiff. |

I know of people who died in Canada because they could not afford to travel to the United States for medical care and they could not have treatment in time in Canada because of the waiting list to see the doctor. |
