You may have missed my point. I don't know if Merrick Garland would have been a great jurist. I don't see that his other two appointments have distinguished themselves in some of their previous opinions UpTo and inclusion the Trump travel ban. That said, once Harry Reid changed the rules, he opened the door for other rule changes. He ignored the warnings and now Democrats must live with what he has brought on.

There is a huge difference between the way Reid changed the rules and McConnell. Reid got rid of the filibuster, which was undemocratic and contrary to the will of the people. 51 votes should always be enough to confirm. What McConnell did was just bullshit. If the Senate had actually voted down Garland, even giving the same reason as McConnell did, that would have been perfectly fine.

There are provisions of the Constitution that are undemocratic. Obviously, those cannot be challenged in court. No one ever said everything in the Constitution is democratic.

Originally, it was ”give the voters (SIC) an opportunity to choose”. The voters have an opportunity NOW to choose who will determine if this candidate will support the law and rights of Americans through Senate elections. And for the record, aside from stomomyer and Ginsberg, I don't have a problem with Roberts either. And kagan I can take or leave, but feel he could have done better on that one too.
