It's called the Supreme Court. It got that way because the cowardly inhabitants of the executive branch and the legislative branch let the courts get away with becoming a super-branch of government instead of reining it in when appropriate. The legislative branch allowed the courts to make essentially new laws and the executive branch allowed the courts to make regulations besides. Look how much power one man-- Judge Harold Greene-- was allowed to reshape the entire telephone industry in 1982. Why was the crafting of telecommunications policy left to the courts instead of elected officials? Of course, I could go on and on. |
