Texasss secessionists launch petition drive for vote to break away

SAN ANTONIO, Texas (Reuters) - A group called the Texas Nationalist Movement fanned out to 31 cities across Texas this weekend trying to gather the 75,000 signatures they say they need to get the question of the state's secession from the United States on the primary ballot next spring.

Texas is one of only two U.S. states, the other being Hawaii, that were once internationally recognized sovereign nations, with diplomatic ties to other countries. Although legal experts said it would be unconstitutional for Texas to break away via a primary vote, there is still a spirit of Texas independence among many in the Lone Star State.

"What we are seeing, over and over, is this complete disconnect between the people of Texas, what they want, and what is going on in Washington, D.C.," TNM President Daniel Miller told Reuters.

"The people of Texas don't have anything against the United States, they are just tired of being governed by bureaucrats we didn't elect pushing programs we don't want."

He compared Texas to Scotland, which narrowly defeated a proposal to secede from the United Kingdom last year, and Catalonia, which is pushing to hold a vote on independence from Spain this year.

"We are living in the era of the right of political self-determination," Miller said.

But there is one rather big problem, according to T. Gerald Treece, a professor at South Texas College of Law in Houston and an expert on Constitutional Law.

"That problem is the Civil War," Treece said. "When Texas and the other Southern states were re-admitted, each of them made a solemn promise that they would never leave the Union again."

Treece said there are some legislative options available to the Texas Nationalist Movement, short of another civil war.

"You have to have the Texas Legislature initiate a request, and then you have to have the U.S. Congress approve it, and then it could happen," he said, adding that with 'two sovereigns involved,' both would have to give their assent.

Many states have discussed leaving the Union over the last century, but the talk has been louder in Texas, with some Republicans, including former Governor Rick Perry, floating the idea of secession.

Texas would certainly have the clout to become influential on the world stage as an independent nation, with a $1.4 trillion-a year-economy, about the same size as South Korea's.

LOL, one, it cant be done. The only thing LEGAL in the state constitution is a provision allows texas to break up into 6 smaller states.

So where are they going to get the money to make up for all the federal tax revenue they receive now? I'm sure everyone will be thrilled to pay taxes that make European countries look cheap.

That is a myth. First, it has nothing to do with the state Constitution, it was a provision in Texas' enabling act by Congress. Second, it allowed Texas to join as up to five states, it did not give Texas the future right to unilaterally split into multiple states.

What Texas once could do is divide itself into as many as five states, a privilege given to it as a unique condition of its annexation to the Union in 1845.

In 1820, the Missouri Compromise had helped save the United States from splitting along sectional lines by defining where slavery could exist in the territory gained in the Louisiana Purchase. Specifically, slavery could exist south of the 36°30'N line of latitude, and no further west than Missouri. The territory claimed by Texas extended further north and west than the Missouri Compromise lines (well into present-day New Mexico and Colorado). Any states north or west of the Missouri Compromise lines would be free; in the others, a popular vote would determine whether slavery could exist.

In 1850, Southerners wanted to exercise the provision to create another slave state from Texas to balance the admission of California as a free state. In one of the provisions of the Compromise of 1850, Texas was instead given a payout of $10 million to give up its northern and western claims. A few years later, the Kansas-Nebraska Act repealed the Missouri Compromise and made the issue of the boundaries a moot point. Although in theory Texas could still be divided into multiple states, any possibility of carving additional states from Texas ended when the Civil War settled the question of slavery once and for all.

That part does not at all imply that such right is inherent in Texas. Any state could be split into multiple states with the approval of Congress. The question is whether Texas has the right to do so without any further Congressional approval and that is not the case.

Note that as of 1912, thanks to the Texas Cession, the land formerly recognized as being part of Texas at its admission in 1845 does form parts of five states: The extant State of Texas and parts of New Mexico, Colorado, Oklahoma and Wyoming. That has nothing to do with it though, as all of those states were formed from federal territories established after Texas agreed to cede land in exchange for federal bonds.

Lulz. That's not the half of it....All those American companies will leave, as will NASA the military (some huge bases down there, the military presence in the south going back to Reconstruction....we could use all those jobs up here), and all the government jobs will be gone. In an instant. They really should try this. Seriously. Upside is they'll have more water per capita.

From the context, I believe(d) that he was referring to the provision in Texas' enabling act by Congress, which both of you were talking about. He said that in theory it could still be done after you said that it could not be done today.

No, he’s not. Vermont was not recognized as such by Congress. It was admitted as having formerly been part of New York. There was also an unrecognized California Republic.

Analagous to the removal of east Ukraine, it would make the United States a more democratic nation. Which is why Republicans in Congress will sink it without a trace.
