Nondenominational minister Anne DePrizio has been sentenced to 30 days, 6 months probation, and a $250 fine after she refused to stop the wedding of a lesbian couple in Prattville, Ala.

Anti-equality groups and politicians love to claim that religious officials will be punished for speaking out against marriage equality. But those same self-proclaimed defenders of "religious freedom" have been quiet as church mice about the case of Anne Susan DePrizio, a nondenominational minister in Alabama who was sentenced to 30 days in jail last month for her stance on marriage.

After a federal court ruled that Alabama's same-sex marriage ban was unconstitutional, DiPrizio conducted a marriage for two women at a probate judge's office in Prattville, Ala., in February. (In Alabama, probate judges are responsible for issuing marriage licenses.) A local judge ordered her to stop, but she defied him and obeyed the federal ruling, returning to the probate judge's office after she posted bail from her disorderly conduct arrest. Her punishment for refusing to vacate the office: thirty days in jail, sixth months probation, and a $250 fine.

To be clear: this is an actual example of a religious official who has been sent to jail for exercising her religious beliefs. It is the very thing that the marriage equality opponents have been claiming will happen to them. And yet none of them are coming to DePrizio's defense.

Last paragraph says it all. It's all about "their" "religious liberty" until it's about actual religious liberty.

Forgetting about the federal ruling for a moment (I know, you can't), otherwise I would think this would be sound.

DePrizio seems to have been acting in her role as a State of Alabama official and marrying two people who were not allowed to be married under state law. It strikes me as no different (in the absence of the federal court ruling) than marrying two 14 year olds in definace of state law.

I think punishing DiPrizio is wrong because it's contempt of federal law, but I don't see any religious freedom issue here. Would anyone object to punishing an FLDS minister for enacting a polygamous marriage in his role as a Utah minister sanctioned by the state?

Would anyone object to punishing an FLDS minister for enacting a polygamous marriage in his role as a Utah minister sanctioned by the state?

Federal judgements supercede state ones, so yes, I would object to a State punishing an FLDS minister for exercising his constitutional rights if polygamy were ruled legal by a federal judge in that jurisdiction.

I specifically stated my opinion under the hypothetical case of no contrary federal ruling. So why is it freedom of religion rather than just contempt of the spearation of powers under the Constitution as articulated for the last 200 years?

So why is it freedom of religion rather than just contempt of the spearation of powers under the Constitution as articulated for the last 200 years?

On issues of marriage, it's long-standing practice that ministers may legally marry people at courthouses.
The marriage she performed was legal.

Unless Alabama also denies courthouse access to clergy performing heterosexual marriages, their action was a clear violation of the constitutional guarantee of the free exercise of religion and the equal protection of the laws.
