So why is it freedom of religion rather than just contempt of the spearation of powers under the Constitution as articulated for the last 200 years?On issues of marriage, it's long-standing practice that ministers may legally marry people at courthouses. The marriage she performed was legal. Unless Alabama also denies courthouse access to clergy performing heterosexual marriages, their action was a clear violation of the constitutional guarantee of the free exercise of religion and the equal protection of the laws. |
