Forgetting about the federal ruling for a moment (I know, you can't), otherwise I would think this would be sound.DePrizio seems to have been acting in her role as a State of Alabama official and marrying two people who were not allowed to be married under state law. It strikes me as no different (in the absence of the federal court ruling) than marrying two 14 year olds in definace of state law. I think punishing DiPrizio is wrong because it's contempt of federal law, but I don't see any religious freedom issue here. Would anyone object to punishing an FLDS minister for enacting a polygamous marriage in his role as a Utah minister sanctioned by the state? |

The marriage she performed was legal. Unless Alabama also denies courthouse access to clergy performing heterosexual marriages, their action was a clear violation of the constitutional guarantee of the free exercise of religion and the equal protection of the laws. |
