Technically he Fifth Amendment only applies to the Federal Government so a state would be free to confiscate all of the property of Jews if it so wanted without Section 1 of the Fourteenth Amendment. |

It's 100% accurate.The 14th also incorporated the First Amendment right to freely exercise your religion and the Constitution's requirement of being free of religious tests and oaths to the several States. Before that it only applied to the Feds. Without it a State could deny you the freedom to practice your religion or to take Christian oath to get that CTA job. Besides eliminating the 14th Amendment, Christianists like Steve King also want to replace the "no religious test" with a mandatory Trinitarian Oath. |

The drafters knew of that language because it is in the 15th Amendment. The language of the 14th Amendment makes clear that its scope is much broader to prevent disparate treatment against any disfavored group |

There is a line of case law from the Supreme Court holding for a narrow reading of the 14th Amendment. There is also an equally long line of those using the 14th Amendment as central to the "Living Constitution." Taken to an extreme either side is wrong, but I do believe that looking at the text of the 15th Amendment which dates from the same time period, the drafters of the 14th Amendment knew of language if they only wanted the 14th Amendment to apply to newly freed slaves. My disagreement with the other extreme is that they read in "rights" that cannot be justified from the text of the Constitution or the contemporaneous writings of its drafters |
