If that were the case the 14th Amendment could say "No state shall deprive a citizen born or naturalized of any right of citizenship on the basis of race, color or previous condition of servitude." The drafters knew of that language because it is in the 15th Amendment. The language of the 14th Amendment makes clear that its scope is much broader to prevent disparate treatment against any disfavored group |
