Used to be charges varied on the value of stolen goods.They still do. But they also depend on the circumstances. If I smuggle a candy bar out of a store it's going to be a misdemeanor. But if I hold a knife to the clerk's throat and say give me a candy bar or I'll kill you, it's going to be a felony. And it seems that many states have decided in their wisdom that if I try to sneak a candy bar out of the store but shove the clerk to get past him I've graduated into a felony as well. |

Now if YOU look back you'll see that posts made subsequent to Dave's disagree with his finding and state that it's a felony. So maybe instead of rushing to character assassination, you could have searched yourself.What "character assassination"? What rushing? Searched for what, where? What are you talking about??? I read the whole subthread before I made my post, and the issue of whether or not it was a felony and whether or not you were wrong appeared to be unresolved. So that's why I asked those three questions. What do you not understand about that? |

Everyone has to get off of the "unarmed" aspect of this. A person doesn't have to possess a gun/knife/weapon in order to still cause another person to fear for his life/safety. Listen, if I had MY way, the PD, FD, Corrections, Sanitation would be made up of burly 6-footers who were street-smart BUT since "diversity" rules the day, along with Political Correctness, this is not the case anymore so if the cop was engaged in a fight with a 6 foot 3 young man and was getting his ass kicked and the cop was 5 foot 7 and the perp wasn't stopping the assault and the cop feared that his gun would be taken away from him because the perp had tried that while struggling in the car, then the officer felt that he had no other choice but to shoot until the threat stopped. |
