Title 8, USC, sec. 1409, para. (C) deals with that. It says children born to unwed American mothers after December 24, 1952, are US citizens, provided the mother has lived in the US for one full year at any time before the baby's birth. This would, AFAIK, include President Obama, whether or not his mother was married.For a child born of an unwed, US citizen father, it's a little more complicated. The father, if still living, has the same one-year residency requirement in the US, plus he must agree to child support for the baby until it reaches age 18, and legal paternity of the baby is sworn to, in writing, by the father or "a competent court". |
