It will be repealed because the huge emotional backlash across the country. Also, parts of it may be unconstitutional.First of all, does hanging around Home Depot speaking Spanish constitute reasonable suspicion of illegal presence in the US? Of course not. So if you decide you can't detain anyone just for being at Home Depot, what kind of activity actually generates a reasonable suspicion, other than someone carrying a sign saying "I am an illegal alien"? What Joe Arpaio says he does is that in the course of normal police work he asks everyone suspected of a crime "Where were you born?" I guess that if they mention a foreign country that he asks what their immigration status is and likely for documentation. Hopefully it doesn't offend you that suspected criminals are being forced to identify themselves and if they can't are turned over to ICE. |
