I am only pro-death penalty for treason, rebellion, and espionage.

You can always have the defendant plead to life with parole, which doesn't mean that parole will ever actually be granted.

By the same logic, if you reach the threshold for being executed, what stops you from going further? There will always be a maximum penalty.
