One of the problems for any federal judge that gets the case, is that the National Emergency Act doesn't clearly defined what constitutes a national emergency. That leaves it open to the kind of abuse we are seeing now.I think the courts, however, will tend to apply the "reasonable person" standard to determine what is really a national emergency. |
