Police are looking for a suspect who allegedly assaulted a city bus driver Thursday morning in the Bronx after being refused a transfer because he didn’t pay the fare.

MTA bus driver Nelson Diaz, 54, said he was beaten up, spit on and had his head pushed into his bus window by the suspect, who fled the scene and is still at large.

“The only thing I told him was the fare is $2.25 — that’s all I said,” Diaz told CBS 2′s Derricke Dennis. “When he hit me, I pushed him away and that’s when he lunged at me, grabbed me by my throat and he pushed me and pinned me against the window.”

The suspect boarded the Bx 41 bus through the rear door at Melrose Avenue and East 162nd Street around 8:15 a.m., officials said.

When the suspect went to get off the bus, he demanded a transfer from Diaz, who refused because the suspect did not pay his fare, officials said.

“All the operator stated was that you didn’t pay the fare. As soon as he stated that, that’s when the havoc struck,” said Frank Austin, chairman of the Transport Workers Union’s Bus Operator Action Committee.

Diaz suffered a concussion and was treated at St. Barnabas Hospital, TWU officials said. Diaz has been on the job for 24 years.

Diaz spoke out exclusively to CBS 2′s Dennis from his bed at his home in Rosedale, Queens, on Thursday night. He was bandaged and was still wearing his hospital tags while nursing a concussion.

“My back is in a lot of pain, where he hit me over here. I still keep getting ringing and I get headaches,” Diaz said.

Diaz’s wife said it could have been worse.

“I’m thankful that he’s OK. He didn’t get stabbed or shot, because everybody likes to carry pieces. I’m just glad that he’s safe,” Debbie Diaz said.

The union said the Bx 41 is one of the most dangerous bus lines in the system.

“It seems that most of these assaults are occurring through fare evasions,” Austin said. “Just the bus operators doing their job and letting the person know they didn’t pay their fare has become a means of assault.”

The Metropolitan Transportation Authority said its policy is for drivers to remind fare beaters of the fare, but not to confront them. By all accounts, Diaz did not confront the passenger, but he did have a message for his attacker.

“I feel sorry for him, I hope he has a conscious, and he realizes what he did,” Diaz said.

Diaz said he will go back to work eventually, but will do so with an eye toward retirement in another two years.

A $2,000 reward is being offered for information leading to the suspect.

This is ridiculous! I hope Mr. Diaz recovers quickly.

It's really scary that there are people out there that are such loose cannons you can't say anything to them. The driver didn't even ASK for the fare; just that since the guy didn't pay he can't get a transfer!

Loose canons? Wrong. They're vermin, pieces of garbage. Hopfully he'll be caught and thrown in jail for assaulting a municipal worker for a minimum of 5 years. Police have to be assigned to ride these buses undercover and arrest all the rest of these animals.

Scumbags like this guy disgust me. I have friends that are drivers and the thought of something bad happening to them because of lowlife scum like this guy makes me cringe. I hope they catch this guy soon before he strikes again, there should be no reason bus drivers or and transit worker period should have to be fearful of going to work and not being able to return home to their families because of people who think it's okay to get over the system.

A QV operator was assaulted months back. Both eyes blacked because he was jumped by 4 men and a woman. The DA didn't even pursue the case. The charges were dropped against the last guy because "he comes from a good family". It was also reported that when the TA was notified of Diaz being attacked a manager asked "what did he do for the guy to attack him?" That question disgusts me but is almost always asked in these situations.

There should be protests outside the Queens DA's office in such a circumstance when the law isn't fully enforced to the letter (presuming it's Constitutionally compliant). After all, when the DA's office refuse to pursue a crime (presuming the law is Constitutional, which in this case it is), the DA is directly responsible for whatever crimes they graduate to. Why bother having a DA if there will only be selective enforcement?

Back in the 80's, a driver on the B-44 in Brooklyn got KILLED by a "customer" because he would not accept a paper transfer at a "non transfer point". Since the Metrocard style transfers came out, they can be used at any bus stop, but back in the "old days", the old paper transfers were only accepted at designated transfer points. So these pieces of shit passnegers have been around for many years, it's nothing new...

his name was harvey shild and he was killed when he refused to issue a transfer to a rider after the rider paid and sat down. he started the same day as i and worked flatbush. he survived viet nam but not nostrand av. the thug who was caught is most likely back on the streets now. the incident happen at av z and nostrand-far from a ghetto. the incident happened in 1981.

The Superintendant that trained me was a little in front of you guys or maybe the same class. He told me the story, the operator tried to run out the back door and he shot him down with a .44 hit him just as he almost made it to the door. It was a man and woman together. They did not pay the fare or they were short is the story I was told. Such a tragedy.

they paid the fare but asked for a transfer a block later. as you know mta policy was ask for transfer when boarding. by enforcing mta rule he was killed. if you know the b7 bus it goes through a very rough area of bklyn. shild would throw passengers off there if they didnt pay. he had a gun in vietnam but not a flatbush depot so he should have ignored such rules in some instances.

Drivers that operate "by the book" almost always wind up in more trouble than if they had simply worked with a little more common sense and a little less feeling of (a) authority and (b) intimidation. The "book" is only there for the benefit of the TA, not the employee.

When I drove, I employed my own set of "real world" rules. This included rarely, if ever arguing with passengers, never making a big deal over the fare or transfers and never getting myself personally involved in any situation that could potentially lead to problems (on or off the job).

With respect to paper transfers, my brown bag was hooked onto the RTS bar pole. I didn't touch them, let alone look at them. Drop whatever you wanted into the farebox or the "transfer bag" and have a nice day. I couldn't care less.

My job was to provide safe, scheduled service to the people of New York City. My other job was to protect myself and the people who rode my bus. Let the TA protect themselves. Nobody was out there looking out for me between midnight and 6:00 AM -- except me, and that's how I operated.

To you new guys who might be reading this -- PLEASE don't sweat the small stuff. Your goal is to go home to your loved ones after your tour. Take the violation with a smile and have dinner with your wife. Or email me and I'll tell you how to beat that violation :-)
