MTA Bus Driver Arrested For Refusing To Drop Off Rider

Posted by Gold_12TH on Mon Apr 23 13:00:10 2012

We guess it was an hour before request-a-stop kicks in, but still! Last night a 29-year-old MTA bus driver was arrested by the NYPD for not letting a passenger off his bus. Seriously. Driver Michael Luca is now facing charges of resisting arrest, obstructing governmental administration and unlawful imprisonment.

The MTA isn't commenting on the incident, which occurred last night in the Bronx on the corner of Lafayette Avenue and the Throggs Neck Expressway, only pointing us to the NYPD for any info. And according to the police, this is what happened: the "bus driver was ordered numerous times to let the person off the bus but refused. Eventually the driver did open the doors, though, and was arrested." Luca was arrested approximately 8:50 p.m.

Police aren't elaborating on what was the problem with the stop the rider wanted, or why the driver was so adamant about not letting his charge off the bus. Any guesses?

Well, assuming it wasn't a real stop, then that's the reason right there: Request-A-Stop didn't kick in yet. Technically, they aren't supposed to let you off except at the regular stop.

But the thing that I don't get is that it sounds like it was a regular stop, but the B/O didn't want to let them off, so the police were called and arrested the B/O when he opened the door. In that case, I have no idea what the story was.

According to the NYDN, the "passenger" was Luca's ex-girlfriend, who boarded the bus to "discuss a dispute with him". She was the only passenger on the bus, and Luca allegedly wouldn't let her off the bus, despite repeated requests from police at the scene.

Keeping ex-girlfriend on board?

Cops busted Michael Luca, 29, about 8:45 p.m. after he refused to let the woman off his BxM9 bus, which runs express between midtown Manhattan and Throgs Neck in the Bronx.

The woman had boarded the vehicle to discuss an ongoing dispute with him, a source said. Luca was on duty and the woman was his only passenger, police said.

The woman’s parents feared for her safety and called 911, a source said. Luca was arrested after cops ordered him to free the woman several times and he refused.

Weird.

Since it was an express bus, wouldn't the first official drop off stop be in the "other" borough? While it may have been scary for the girlfriend, she effectively boarded a BxM9, and the driver would not let her off until the first designated drop off point.

That said, cop's orders always trump official policy, and he should have complied the first time he was told to let her off. So he's probably screwed.

Yeah, but there has to be more to this story---such as someone becoming belligerent.

The other version I heard was that the driver wouldn't let the cops on the bus. That seems to make more since as to why the cops arrested him.

Agreed. There is NO woman worth that. If you have to fight on your job, both the job and relationship are finished. And, you could possibly have a serious accident from not being able to concentrate on your livelihood. If you can't get along with a particular woman, walk. There are plenty more (millions) available on Craigslist, POF and other dating sites.

Now, what if the situation was flipped? What if, instead of refusing to let her off, he ordered her to get off but she wouldn't?

Huh? You, Joe Saitta, have posted strong implications that you've had sex with women on your buses, seemingly during LI Bus layovers. So you seem to think that a woman is worth losing your job over:

"My favorite customers are females from "south of the border" all the way to South America. When opportunity strikes and there's no "danger," go for it! After that, no comment. One thing I do miss is the soft seat buses and decent "lay"overs. Let he who has never sinned cast the first stone....."

NO!!! The bus driver is doing his job. if the bus driver does not deem it safe to drop off than he doesn't have to drop her off even if the cop tell him to.

From the MTA NYCT Rulebook (that doesn't officially exist):
Rule 7.04
7.04(a) Operators must familiarize themselves with and obey all regulations of the Police, Traffic Departments and Vehicle and Traffic Laws.
Bus Operators are required to follow the instructions of any police officer who properly identifies him/herself noting the name, badge and precinct of said officer on the Daily Trip Sheet and to the Command Center.

Even TOs and CRs are supposed to follow orders from police I.E "stop the train here we are going to key on" or "Tell your CR do not open the doors" Of course you call it in to Control.

Reminds me of what happened on the B49 on a trip home from the beach in the 1960s. This was before you could only ring once. The driver was getting annoyed that people were ringing multiple times for the same stop. So he made an announcement that if there is more tan one ring he will not stop.

An unlucky passenger rang to get off at Avenue W. He rang a second time just before the stop to be sure the driver heard. He skipped the stop and explained why. More than one ring occurred every block and the driver wouldn't stop. The man got very angry then and purposely rang the bell about 25 times. Long story short, the man was let off at Avenue K when he rang only once. All this time no one had to get on.

There were no cell phones to call the police. Good thing the bus driver didn't work for Mr Softee.
