Posted by salaamallah@hotmail.com on Tue Nov 22 20:14:54 2005 can a 1986 student loan take away money from your SSI ?if i am on SSI benifits and i have a $7000.oo student loan i can not pay can they take away my SSI check ? and use it to pay the $7000.oo i used to go to school back then ?? i am worried about them taking away my SSI this might put me on the streets omg |

Did they pass this or was this made into law?I know, even though they just cut student loan funding to pay for people "building schools" in iraq(talk about racism against the homeland), student loans had different laws protecting it than other credit. You can't get rid of it through bankruptcy, or evade it. I don't know if you lose benefits from it though. That would be extremely stupid and silly. If someone could afford to repay all that, they probably wouldn't be on social security or other programs anyway. Right? |

Hence, I'm afraid :) that Salaam will be held accountable financially when they catch up with him........Laws known as statutes of limitations prohibit the collection of debts via lawsuit after a certain period of time. It varies by state to state but usually is six years. If, therefore, you get a call from a bill collector about a Visa bill that's been unpaid since 1995, you don't have to worry about them suing you (even though the bill collector will threaten all sorts of legal action). Federally guaranteed student loans probably are governed by different rules. While I don't know the limitations period for suing, it almost certainly is well under 19 years. If you take out a loan,it has to be paid back. If you're unable to pay, you talk to them and explain why you can't pay it back. If you default, they have the right to get payment whatever way they can. It'd be different if it was a grant. But the subject line says loan. Did I miss anything? |
