Actually, it is the job of the Dispatcher to investigate unusual occurrences in his area, and if a dangerous situation exists, to report it to the Rail Control Center. Somebody taking a flash photo near the Train Operator's position, for example, could annoy the Train Operator. From where he's sitting in the office, all he could see is the bright light going off. I would go out myself; if not just to make sure it wasn't a fire being sparked, but if someone was taking pictures, to see if it was anyone I knew, and say hello.Of course, it just makes your story sound all the more phony when you make such ignorant and false statements about what you believe employees are supposed to be doing. This is why many employees look down upon know-it-all buffs. |

If you have followed my posts you should know that I am a crusader of sorts for photographer's rights.The only way transit agencies, police and other authorities will stop harassing photographers is through repeated lawsuits. It isn't about money - it is about the law. 1050.9c is very clear and it is the responsibility of the MTA to ensure that all of its employees are aware of its terms. I do intend to enforce my rights through the courts if necessary. I am not one to just accept being stopped from engaging in a legal activity. I have my NYCLU contact, two attorneys, and two press contacts on speed dial on my cellphone if I were to be detained. Hopefully it will never come to that. |

I'm talking in general and not making a judgment on this case because if your flash did fire then the employee was at least partly correct.I say partly because I am concerned about the part where you were told to delete the pictures. Even police cannot force a photographer to delete pictures without a court order. That applies even if the pictures were taken on private property while trespassing. The most anyone can do is ask you to leave the premises. |
