ROBBED BY A COP— AGAIN!

Yet again, the police just can't seem to get enough of me my stuff. I don't have a lengthy report to give right now, and I'll have to be a little stingy with the details for now, since I'll be pursuing litigation.

Anyway, the bare facts are these:

I got off a Metro-North train at Grand Central and noticed a great photo op on the next track over, so I took out the cammy and began taking pictures. Some Metro-North workers came up and said photography was illegal. I told them otherwise; they asked for "my papers." Heh. I told them I didn't need a permit— photography was legal. Period. They said it wasn't. I asked them to ask their boss. They summoned the cops— and the military. One officer and two soldiers came down; other officers came later and I don't recall offhand exactly how many ultimately walked past in total. I'm pretty sure there was a third soldier at some point too. Anyway, one of the first things the officer did was demand that I shut off the camcorder— after the last incident, I always record the entirety of every encounter. When I asked what would happen if I refused to shut it off, he grabbed it and ripped the battery out. Ultimately, I was detained for quite a long time, and was eventually given a summons for "tresspassing." (You need a ticket to be on the platform, unless you'd just gotten off a train; I'd just gotten off a train; they demanded to see my ticket; I told them the conductor had taken it, of course, but I had the receipt, which I showed them; they didn't care to notice it.)

I got names and badge numbers from two officers— the "ringleader" who was there first and one other. I tried to get a name and serial number from one of the soldiers, but I couldn't. When I checked the camcorder some time after they'd left, I noticed that the memory card was missing, along with all the photos that were on it. Luckily, the video from the incident is unharmed; I have it safe at home on my camcorder's HDD. I'm guessing he wanted to cover up the wrongdoing on his part and didn't know that he hadn't taken the right media from the camcorder.

Since physical property was taken, as well as various damage inflicted and frivolous charges filed, I won't leave this with the CCRB and I will be suing. I've already written up a letter to the NYCLU. Since I'm going to be taking this to court, I'm afraid I can't give you a crystal-clear picture of the whole story here on a public message board, but I'll give you updates when I can.

It was announced on the Metro-North ACMU trip back in December 2004 that photography on the Grand Central station platforms was against the rules. I haven't noticed any signs/official documents backing this up, but keep that in mind.

Good luck with the lawsuit, though.

You have explained it vividly.

Your platforms don't have videocamera's do they? Cops there must have more freedom. Everywhere else cruisers have camera's usually, or in some way police conduct are recorded. There looks different.

They were LYING! A letter written by the MTA to the NYCLU states otherwise. I challenge anyone to find that rule in writing!

Lmaooo.....I had a train operator on a "b" train tell me picture taking was illegal....I had taken a pic at 182-183rd st, and got on the train. After about 4 stops he opened the door and called me over to explain. I didn't really argue it, but no big deal to me....

That's not true. You're allowed to buy a ticket on the train. So all you had to do was say you were getting on a train on a certain track and would buy your ticket on board.

No, IIRC, they either asked us or told us not to take photos, but didn't say that it was against the rules. Because it' not. It may be against that "you need to have a ticket to be on the platform rule", but that's easy to get around.

I can't remember the exact wording of what they told us, but it was definitely along the lines of "no photos except of the ACMU."

Not that I condone these restrictions in any way, of course.

The reason no one else seems to be robbed by cops as oftern as he is is because most people don't make it an adversarial situation by asking "what would happen if I refused to shut it off". Most reasonable people would just say yes sir and be on their way.

That was before the new information and rules were promulgated, the letters from the police commissioner should always be kept on one's person. You should not depend on your video equipment to record the conversation. You should have a mini-recorder of some sort in a different pocket, out of sight.

Agreed, but the MTA police had no legitimate reason to stop him from filming. If he takes the trouble to sue, good for him.

I've got nothing against the police who patrol the system. They are doing what their supervision has instructed them to do. In the case of railbuff photography or video, those marching orders are of no security value, counterproductive and wasteful of officers' time. They also produce resentment and distrust of officers by law-abiding citizens.

That is disgusting, if they really took your memory card, and got so physical. Whenever i hear stories like these, about cops going on power trips, i think it is either due to a bad day, or he has to prove his manliness to everyone.
Size doesn't matter, it's how you use it, work with what you got, that is the path to success and happiness, but these cops don't understand that. Damn.

Were these young officers? Younger ones tend to be idiotic, and they follow the fads. Older ones tend to be reasonable, and disregard this "Terroristical" photography. They think for themselves.

They should publish a story about this paranoia in the Times....HAHA. It might become like McCarthyism, but longer lasting. We won't quit until everyone in the middle east is a democrat, and we'll make them like it. Shame. We even have no fly lists, suspected terrorist lists, and all this nonsense.

Did they put you on any "list"?

you don't object to the militarisation of public transport, the aura of fear, the color threat levels which magicly shifted with political winds in DC. Perhaps you don't object to warrantless seareches of your communications, your banking and travel patterns. maybe you believe idle tourist or railfan photography of PUBLIC areas of transit is not a protected right. Does that extend to a postcard like view of a public building? bridge? Having a poorly or fraudulently trained but ARMED cop who not only takes you into custody but sabotages your property on his own authority may not seem like illegal search and seizure to you. Does to me. So speaking of several articles of the Bill of Rights being essentially cancelled seems accurate to me.

First and foremost, Nilet, what was the special photo op at GCT that you had to get a picture of? An M1A? M2? M3A? M4? M6? M7A? Shoreliner? Phoebe Snow Cars? Private Varnish? What? And you could not go anywhere else on MNRR to get it?
Secondly, I was also on the ACMU Farewell Trip back in 2004. I remember the lunch stop at Grand Central Terminal. We were told before we arrived that you may photograph ONLY THE ACMU EXCURSION TRAIN!!! DO NOT PHOTOGRAPH ANY OTHER TRAINS ON ANY OTHER PLATFORMS!!! I believe we were informed that it is not allowed on any of the platforms and the exception was for our special train. It was also told because they did not want anybody wandering around where you are not allowed or on trains that were sitting idle on adjacent tracks.
Also, I hate to be the bearer of bad news, but I just spoke to a friend of mine who is employed by MNRR. A higher up you can say. Anyway, he told me that photography IS INDEED ILLEGAL ON ANY PLATFORM OF GRAND CENTRAL TERMINAL for the exception that you are escorted by Dan Bruckner-MNRR President.
Inside the terminal such as in the main concourse-they will not bother you. Also anywhere else on MNRR, they should not bother you.
Yes, they may come up to you and QUESTION you. But they SHOULD NOT bother you as long as you are not a distraction of operation or on another's property. But again, we still hear the stories.
Nilet, I don't want to say this, but the MNRR Employees, MTAPD and Armed Forces were justified with what they were doing. You did not help the cause either by brushing them off or by saying it is legal when it is not. If you showed the employees a printout of the photography rules, the outcome may have been a little different.
You are just asking for trouble every time you go out and take photos. This seems like an every week occurrence with you.
IDK if it's your approach to taking photos or what. You may want to give it a rest for a bit.
