Assuming that the railfan in question was accurately describing the situation, the conductor had no right to confidscate the tape. The railfan culd have refused to hand it over.If he can afford $100, he can get an attorney to write a demand letter to return the videotape or pay damages. A RFW tape of the LIRR main line is already available commercially. I found it in a bookstore. |

The conductor was acting out of order. The conductor has the right to tell him to stop filming (and even that is a grey area, considering he was doing something perfectly legal) or to get away from the window in order to protect the engineer (some of the M1/3's have sliders on the front seat that say RESTRICTED AREA), and the conductor has the right to kick him off the train, but the conductor has NO RIGHT to confiscate anything from the customers which is their own property. Even a police officer wouldn't legally be able to take his tape, unless it was related to a crime. NEVER willfully give over any of your own property unless you never want to see it again. |

Yep, and I have a commercially produced LIRR video of the Main/Port Jeff line from West Side Yard to Port Jefferson which was filmed in 1995. I think that with the exception of some parts of Nassau interlocking, and the new Port Jefferson yard, nothing has changed since then, which is why I've never made an effort to film that portion of the system myself. |

Wow, although I've encountered my fair share of a-hole LIRR Conductors, I've never seen one go this far. I did have a couple of incidents on the LIRR and NJT Commuter Rail where C/Rs tried to "grill" me down, but I just "grilled" them back and they would just walk away. During the only time I filmed Metro-North, when I looked at the Conductor to see what her response was to seeing me filming, she just smiled and told me good night and continued onto the yard. Hopefully that guy is seriously punished. |

Similar experience on NJT recently... Conductor lady walks by collecting the seatchecks and sees me with camera lens pointed straight ahead (asif I were shooting--- but twas only adjusting manual focus and shutter speed settings)... she stops.. steps back two steps... and mouths the words "sorry im in the way". (and this was on a crowded, inbound NJT interval) Cops at Newark Penn have "grilled" me several times (2 or 3) but have been courteous and professional in demeanor. Tendency is that they back down after I show Photo Permit and/or Warrington's letter. |
