Yup, safety trumps all. As a responder I can not enter a scene until it is safe to do so, and I must take steps to keep the public safe too. Say a big old tank truck is on its side in the ditch. Damn sure I'll keep 600 feet back, and will not permit other traffic to pass me. I'll close the road and the hell with the cops and stuff. Let them do what they want when they get here.

I got binoculars on the rig, and if I see a placard that it until Hazmat comes and says otherwise.

Um, maybe this might be a tort matter.

Like maybe someone at NYCT might want to speak to the photographer.

Or maybe this is now an ongoing internal investigation, with the T/O and C/R involved.

Yes they are.

They always will be no matter what anybody says they only "answer" to the Gov thats it..

They may give John and Jane-Q-Public "answers" but just some not all and not the whole picture..

They may close a platform to the public if safety demands it.

Seen it done at Lenox like i stated earlier..

They may close a station or even a line if safety demands it.

Seen it done on the 5 Line due to High Winds that could knock down trees, seen them shut the 2 Line down due to the BlackOut in Wakefield which did not affect the trains but they did not want people leaving the station in the pitch black dead of night.

There aint squat you can do about it.

To just take a bus or a car or a cab and deal with it, beacuse it happened to me when i was a passenger as well...

This isn't one of them. While the MTA could certainly ASK the photogapher not to share this photo, they have no power to prevent him from doing so.

Actually, most do understand that if the MTA didn't want this pic taken,and if it was taken by an employee, the "beast" would strike back. The question is moot, since the pic was not taken by an employee.

I see..

Of coruse there are "other" factors in this as well that few know about little things that lead to other things..

It really dont have Much to do with the picture taken but its part of it.

I will leave it at that.

Pictures of the accident train have already made nycsubway.org! Go to the newest images section. It would appear that there isn't any photos of the first two cars that actually hit the bumping block, a note was added to the caption saying those cars would be sent to Coney Island for scrapping.

Talk about fast.......

Huh? That has nothing to do with anything. Passenger on in-service platform within authorized area sees something. Passenger takes photo. Passenger posts photo. 100% OK.

IAWTP. Anything in public is fair game for a snapshot, even for the MTA since they allow photography.

The only concern I do see is that they may get angry by this and try to change the current regulation and try to prevent photography, which would be impossible to do.

I was specifically referring to non-employees. The MTA can't order people to do something it's own rules state CAN be done.

Sure, they can:

21 NYCRR 1050.3(a)
"The Authority reserves the right from time to time to suspend, modify or revoke the application of any or all of the rules as it deems necessary or desirable."

That sounds like it only applies to the "agency" at large at an official meeting, not at the whim an individual MTA employee unless as the "Lion" says, there is a clear and present danger of injury to passengers and/or other employees.

Ah, nope, thats OK, a foamer is some one who does not work for transit, and gets caught in the back of an R160 train, riding the back cab, going to school, and now there looking for that person, and this person got caught twice, and now there looking for him. I aint like that.

I guess the ony harm is that the t/o would be 'made an example of'. Other than that like the TS-GC S crash, no one can stop anyone from taking a pic of the accident. It happened, and nothing can be done about it.

Impressive photos.
From what I can see that damage is pretty severe. With the quick disconnect box disconnected and the king pin out of its recepticle I'd say that the train was traveling about 15 MPH or less. I trust it was an 8 car train so there's plenty of inertia to sustain such damage at relatively low speeds. And that bumping block was going no where. Anyone know if it was mechanical or electrical malfunction or did the Motorman have a medical episode?

To many "Grey Areas" i will leave it at that..

The Medical thing is being talked abaout in the Crew Rooms though..
