I can appreciate that attitude. It seems to be the prevailing opinion on this board. I respect that police have a tough job, but I believe that they still should follow the rule of law. They should not be allowed to demand information above and beyond that required by law or be able to illegally search law abiding citizens. That being said my intent was not to be self righteous even if I sound otherwise. If I thought that he wanted my ID solely to confirm my identity or even to run a warrant check, I wouldn’t have had a problem. I’ve given my ID to law enforcement many times during traffic stops (even the four times that I’ve been pulled over for bogus reasons). My concern was that he wanted my ID for reasons beyond those. This suspicion was confirmed by the commander who said that even had I given him my ID forthright, my name would have been added to a terrorism watch list. Knowing that, I can’t honestly say that I’d respond differently if given the chance. If I go to court and they tell me I’m a moron, I’ll of course have to reconsider my actions;)

Dude...you pushing it. "Rubbing it in their face" ain't the wisest action to take. Guys standing on a street peeking through fences taking picture after picture of train yards and tracks are always gonna appear strange to anybody witnessing it. This is nothing to be surprised at. To non railfans passing by it looks a little weird, face it. You gotta expect that odds are good some knucklehead will call the police. So I would think that discretion is a good way to approach the hobby, not beligerance.

Yeah, it sucks. Then again, who told us nuts to have such a bizarre hobby?? What, we can't collect stamps??

You might not do so well contesting the charges. I don't know how it works in Cali specifically, but Disorderly Conduct refers to you, basically, making a scene. Which you did.

It doesn't matter one whit whether the original "violation" was bogus - if you made a scene, you get cited for dis con.

Similarly, if an officer tries to wrongly arrest you, and you resist, you get charged with resisting arrest. And even if the original cause for arrest is thrown out, the resisting charge can stick.

The way to handle these cases is to yes them to death.

Yes, you can ask questions, but do what the officer says. If he wants your ID, give him your ID, while simultaneously asking (in a polite tone of voice and as innocently as possible) what seems to be the problem.

In any event, I would contact the ACLU and get their legal advice.

it depends on whether or not the vicinity in question has a so-called vagrancy law, under which a LEO can ask for identification for somebody on the street. If there is such a law, then the request would be appropriate. If not, then you have every right to refuse to present ID. Then you get arrested and have your day in court and the charges get dropped. (The first ancillary question is whether it's worth it to go to that trouble, or just fork over the license. The second ancillary question is, if you're not sure whether such a statute exists, you have to assume there is one, lest you risk being booked on a valid charge).

The third question is whether such a vagrancy law is Constitutional. I don't believe this question has been settled. In the recent Hiibel case, SCOTUS ruled that such laws are constitutional, but in a case in which a post-felony investigation was being conducted, not a "stop-and-search" such as this.

The Hiibel case referred specifically to an officer's power to demand ID in a post-felony investigation.

Say, you're responding to a report of an assault by a perpetrator of some description. While canvassing the area you find a person fitting such description and ask for his ID, what's going on, etc.

That's what the Hiibel case is about, ascertaining the identity of someone for whom there is probable cause committed a recent felony.

Now, some guy walking down the street scratching his ass... no, in general he doesn't have to have any form of ID, in most jurisdictions, unless a so-called vagrancy law exists. I'm not sure these have ever been challenged in court.

Not to split hairs, but what my citation actually states is "unruly behavior." I have no idea whether that is the same as disorderly conduct. They sound equally bad to me.

I never made a "scene" unless you have a very broad definition of what that might entail. He asked me questions and I calmly answered each one, even though my answers were not to his satisfaction. Neither one of us ever raised our voice. He used that tough, in charge cop voice, which made him seem angry, but I couldn't say for sure if he actually was. Our conversation lasted maybe 20-30 seconds before he handcuffed me.

By the time it was over four of the five deputies (including the commander) spoke to me at some point. Every single one of them said that what I did wrong was not presenting my ID. There was never any mention of unruly behavior. Even as the original deputy handed me the summons he reiterated that my mistake was not providing identification. I was surprised as I signed it to notice that the infraction cited was unruly behavior. I'm still perplexed.

Not true. As has been mentioned several times in this thread it was to decide whether or not the Nevada law allowing law enforcement to ask for identification if they suspect that a crime did, is, or is about to happen. It doesn't have to be a felony. Also the courts had ruled before that case that stating your name is sufficient for identification. You do not have to show identification. You do not have to give your address. You do not have to offer any more testimony other than your name. You can google "stop and identify statute" for lots of info. This one is pretty thorough and there are lots of legal sites if you prefer.

Look on those cites and you'll see that the original vagrancy ones were overturned in 1972.

I meant Nevada law enforcement could ask for "identity", not identification. The Nevada law only required that the person identify himself. The distinction is caused Cali's law to be thrown out in 1983.

In Russia you can be locked up under a law which translates roughly into "unspecified hooliganism." However, contrary to popular belief not even the Russians had enough cells or resources to lock up everybody. The Moscow Militia was always quick to complain (even during the later Soviet years) that the drunk and disorderly, the ones who got into bar fights, drug users, small time burglars, got off too easy.

There was even an episode of the show "Cops" that featured street patrol officers in Moscow. One call they answered was to an apartment where a ma was beating his wife.

I think the issue you need to raise with the lawyer is whether it was appropriate for the officer to demand ID. If not you might have a hell of a case against them, particularly considering you were handcuffed. The dis con, or unruly behavior, or whatever it's called, might still stick though.

OTOH, if the request was appropriate, you don't have a leg to stand on.

There's some placing arrest language here, no? What did he say while he was cuffing you?

I don't doubt the accuracy of your account; however it's not the lyrics but the tone that makes the music. You have the right to take photos, but a cop has the right to ask you why as part of his job.

I'd bet a six pack that the judge looks at you and calmly states "next time show your ID when an officer requests it" (I'd like to lose this bet). This isn't going to be the Scopes trial. As others have stated, I'd consult an attorney, not so much for beating the ticket, but to have your name expunged from this "anti-terrorist list" if there is one. There must be, since the cops all along the Shoreline just wave to me when they see me with my camera around my neck.

And no, I'm not being an armchair railfan here. I've been questioned by police many times while railfanning. Showing ID really isn't as big a deal as the majority of you think it is. In textbook terms it is, but in the world of common sense it's not.

butthe attitudes here and the atmosphere is totally different !!..

in your face now type of approach. it seems that law enforcement

out here is everybody is a ''bad guy'' who does not wear our issued

uniform! when they come at you like a defensive tackle after a

quaterback and bum rush you hard amd make persons clam up in a

defensive posture it only makes them go to the next level the hard

handcuffs because they have this sickness in their heads here that

the transit riding public is always guilty of doing something wrong

They have to file a report so since you have the time of occurence on your summons, it can be easily traced. It's not the end of the world if you don't get everyone's badge number.

I dunno, I have taken photos on the west coast, and never experienced anything like that, in fact quite the opposite. At the Commerce station near LA, there were a bunch of Metrolink workers doing some trackwork, and when they walked past me and the person I was with, they said "Good Morning", and kept walking.
Most Union Pacific trains I have photographed out there, I have even gotten a blast of the horn, and a wave from the engineer when taking photos of his passing train. The horn blast scared the hell out of me, and occasionally blurs my photo, but that's besides the point - haha.
At Union Station, I had taken a few photos of both the gold line and Metrolink, and while I didn't get a "good morning" or something, I didn't get bothered either. There was cop at Union Station once when I rode the gold line, but he didn't say anything, but he probably just thought I was a tourist (which really I was)!

I've noticed that transit agencies on the west coast are MUCH more accepting towards photographers than their counterparts on the east coast.

i did post may times most of the time i do not even get l00ked at

but there are times they act like here they are on the RAG

i remember one day at 7th and metro people were being bum rushed

just for taking pictures of each other family members !!

very agresive !! and over the top !! why that day i do not know

but the gold line seems to be the most agressive when it comes

to taking photos if you fire your shot and only take a few and

quickly disapear to the next station no problem

but if you stay in one location too long the POSSIE will arrive !!

Even if the request was appropriate, the way it was handled was clearly not, as evidenced by the supervisers's response.

So yes he does have a leg to stand on - but he still needs a lawyer.

Part of the reason Salaam may experience a problem is when he puts on that orange vest of his and tries to blend in with the employees. While it's not illegal to wear a vest like that, the intent is evident and they probably don't like that....

I'm sure that I could have handled the whole situation better. But I was taken so much by by surprise that I kind of verbally stumbled through the first few seconds.

There was no arrest made. When I asked why he was handcuffing me, he said it was for both of our safety. I asked what happened that made the situation unsafe he said that we're on a train platform, trains are only feet away, and the fact that I was not complying with his request made me a potential threat to his safety.

Same here. When I take pictures of Amtrak trains those guys are really cool. They wave say hi, etc. Interestingly, even though I've only taken pictures of Amtrak trains a few times, there were always other people (some passengers, some not) taking lots of pictures of the trains at the same time. The Metrolink people just stand there, but they've said that I could take pictures and have never said that I shouldn't.

MTA is different. I've only occassionally seen other people that weren't tourists taking pictures. There's never anyone from MTA around to ask if it's okay so I never do. I'm only there for seconds or minutes anyway. I did have an MTA guy jog over to me once and ask what I was doing. I told him and he said, okay we have to ask and referenced 9/11. I left without taking additional pictures because I felt uncomfortable. I thought that someone must have reported me. I had been there longer than usual that time.

It would help if you wrote full sentences, used proper punctuation and proper spelling. It would help if you didn't say everyone else was "wrong, of cource". Perhaps you can hire a secretary who can write without double spacing and putting only 5 words on a line, in my very "wrong" and humble opinion :^)

411 is national in every major phone company (there are only 3 now). But you are charged quite a bit if your request is out of your state or local area. I don't know what it's like for small phone companies (are there still any, like the former GT&E in Beverly Hills, CA, or in Scranton, PA?

That's probably why I never get bothered. My hobby style of taking photos is just snapping a few and moving on. I get bored in the same location if I am there too long. I mean how many photos can you have of the same type of train coming down the exact same track in the exact same location. I take a photo, and leave.
