It could be construed that way I guess. That's not what I meant. When he asked if I wanted to escalate it I was thinking of course not. Why the hell would I want that. I just want to get on my train and leave. Why would I want to escalate it?I don't know what happened really. I'm not an activist or such. I've given my ID to police, bouncers, doctors, whoever. It's not a big deal in general. In all previous cases I knew why they wanted my ID and what they needed it for. When I got stopped for speeding (3 or 4 times) they always say "I stopped you because..." They don't just pull you over and say that "Well you really weren't doing anything wrong, but I'm going to need your ID for our records." |

The fact is that you sound like a very reasonable person who, in all likelihood, would not look to engage the police in a confrontation. However, if you read some of the posts here, you'll find others who would dare the officer to knock the chip off their shoulder. When the cop approached you, I'm sure he couldn't tell the difference.You are correct, though. He could have asked for your ID in a less menacing way. |

Thanks. I've won in traffic court before when it was my word against an officers. He even lied about the circumstances of the ticket. If I'm in the right (I'll try to find out if I am) I feel pretty good about my chances. If he doesn't show, it will be on purpose. Police in Cali are pretty good about showing up for court.I'll let everyone know how it turns out. |

The commander was adamant that the only thing I did wrong was not producing my ID when asked (even though that's not what my summons says). If this were me, I would have shown ID the first step. However, if it indeed gets to the precinct house, then the person should contact the ACLU and challenge the arrest (and the officer's authority to arrest---and then argue that rather than refusing to show ID, the person simply wanted to know what was wrong. (That the subject did not want to show ID is NOT valid, as the US Supreme Court ruled last June that such an offense (or not carrying one) is an arrestable offense, and so one would have to argue that the officer needed to give him a reason for requesting ID.) The main thing that would be challenged is that officers should be smart enough not to take a question being asked in such a situation as a No (and a lawsuit may be needed to actually bring such changes).The question is, if the LAPD were to offer a settlement, should it be taken (since the city, even with deep pockets, may be in for several years of battles as it works through the courts), or should one hold out for a trial? |

Answering such a request by changing the subject or asking questions is tantamount to a refusal, it would be seen that way by any interviewer: If you were looking for a job, you would keep looking; If you were with a psychologist, that is where he would keep digging; If you were having an encounter with a Sheriff, it is were they start writing.I would have handed him a business card, saying that I am a hobby-photographer. You have diven him identification without presenting a photo-ID card. If he has a problem with that (after all you do NOT have to carry an ID card with you), then he will have to make an issue of it. You can tell the judge that since you were in no way engaged in an illeagal action, that you did not expect to be stopped or questioned by an officer. While an officer does not have to answer your question, the officer's statements requests and questions to you were quite improper, and may be seen as such by the judge. Especially as you have written them down carefully.The officer's third request should have been: "The law requires that you show me identification at this time." Once an officer makes contact with a person, a contact report must be written, either a summons or a note in his book. Me thinks it would be helpful to have a micro-recorder in your pocket that can be switched on when needed. Most Sheriff/Police agencies already do this. Usually the cammera in their car does this for them at traffic stops. The officer *was* unprofessional, and this needs to go further. The worst that can happen is the judge will make you pay the fine. Most likely, he will let you off. ROAR™ |

The exact case was Hilbel v. 6th Judicial District Court of Nevada. The details are here. It was actually decided in 2004, not 2005. By a 5-4 decision, the US Supreme Court ruled that failure to produce ID upon request by law enforcement is an arrestable offense.In short, the Supreme Court of the US did rule that in June 2004. The answer to your question is yes. |

Not quite as simple as that. The courts have overturned stop and identify stautes that allowed requests to be made when there was no crime suspected. California's staute was one of the ones that was overturned. It allowed ID requests even when there was no crime committed.The supreme court was very split on that case. It would seem that I actually have a much better case than the Hibel guy did. He refused 11 times to show an ID. I had a 20 second conversation and never technically refused. They also said that he really had no legitimate concern that giving his ID would harm him. Since my information could and would be added to a terrorism suspect list, I had a legitimate concern. Still even though every deputy said that the only thing that I did wrong (including the one that stopped me) was that I refused to offer my ID, I was cited for unruly behavior. I wonder if that was to cover themselves. When I was speaking with the commander I noticed them huddled together around my stuff. I think that they were looking through my photos (I know they were a few minutes later), but they may have also conferred on what offense would be the most appropriate. Either way assuming that the truth is told by all parties, I'm starting to like my chances for contesting this citation. |

The original deputy did say that I can't take pictures in the subway because of 9/11. He refused to say whether taking pictures violated any laws or even LACMTA rules. It was more of a common sense type thing to him. |

You need to reread the case. Your conclusion is false.The Supreme Court said that a refusal to identify oneself to an officer in the context of the officer's having reason to believe you may have committed a crime is an offense. Reread my post. If I am walking around with no identification on me, and the officer stops me without suspicion of a crime, he has no authority or basis to arrest me. Arrest purely for lack of identification is still unconstitutional. |

As near as I've been able to find on the net, the courts have ruled that you are required to identify yourself when requested if an officer suspects that a crime has, is, or is about to occur. The courts have ruled that telling the officer your name satisfies this requirement. You are not required to show an ID of any sort. You do not have to give your address or anything else. You don't have to give any other testimony. The deputy in my case never asked me to identify myself. He asked for my identification. This seems to be a significant distintion.A business card (along with verbal identification) would not be considered substantial proof of identity, at least in California. It would likely escalate from there, but at least you couldn't be charged with failing to identify yourself. From my understanding of recent case law, neither can I. |

More like French government officials who were sympathetic to the Nazis and cooperated with them.A fair number of French citizens didn't seem to mind either, until German troops shot a number of them and the French found out that complaints to German military supervisors or Vichy govt officials resulted in retaliation. Then they got the picture and decided to help the Resistance. |
