So far, my investigation finds this statement to be inaccurate. As American Pig pointed out they have to suspect that a crime is, was, or is about to be committed. Furthermore, they can only ask you to identify yourself. The courts have said that you do not have to produce identification. You can state your name and are required to do nothing whatsoever beyond that. They can take you downtown and give you access to an attorney if they need more than that.Generally I agree with you, but given 9/11 and the after effects I had a bad feeling that giving him my ID in that circumstance could be to my detriment. I was afraid that I might end up on a list somewhere, and if the commander was accurate I was correct. |

It seems like the LA Sheriffs Dept are downright paranoid. The LAPD, when it comes taking pictures of the equipment out here, doesnt really give a crap. All theyre intrested in is people that are actually committing crimes. Same thing applies for the Long Beach Police Dept and they actually patrol some of the stations in Downtown LB ( though they dont patrol LBT ). There was one instance where 2 guys were taken into custody ( by the LA Sherrifs Dept ) near the UPRR Dolores Yard in Carson for taking pics of the locomotives on Alameda Bl .... A PUBLIC STREET !!! I'd would get the ACLU involved in this thing, even an attorney. Theres nothing wrong with transit photography. But this is something I've known since childhood: cop asks for i.d., you give him the i.d. as soon as he asks you for it, then you start explaining things. I've had a few dealings with cops and not once has any of them been unwilling to listen to what I have to say after I've presented whatever i.d. I have. To question the cop at that critical moment is definitely going to be seen by the police as being antagonistic, at the very least.So why bust their balls? Just show your i.d. and then you can get righteous about the incident if you must. At least you will have fulfilled your legal obligation as a law-abiding citizen. I would be more on your "side" if you hadn't been so reluctant to present i.d. to the cop. |
