If your account of the incident is accurate, and I have no reason to doubt it, then it would appear that the police officer asked you for ID and you failed to comply 3 times. I believe that police do have the right to ask for identification - in NY, anyway. A refusal might constitute an infraction. Before I'd fight it, I'd seek a legal opinion. Despite the reason for the request, your refusal may have been illegal under the law. |

Is photography specifically forbidden by any law in LA's code? If what Easy was doing was not forbidden there was no reason for him to expect to be stopped and he was well within his rights to raise the questions he did. It shows a lack of courtesy on both parts that neither party complied with the other. However, if photography were forbidden then the officer would have been easily able to explain his reasoning for stopping Easy.At what point do we go from 'being prepared' to being a police state? If a cop walks up to you on the street, tells you you're acting suspiciously and demands an ID do you always have to give it over to him? Correct me if I'm wrong, but I believe showing your papers to overanxious law enforcement officers has traditionally been a hallmark of the classic police states around the world. As Americans in a society which ostensibly free it is incumbent on the police to only stop those who are truely being suspicious or demonstrably breaking the law. Clearly Easy was not breaking the law, and photography is not a suspicious act, so he was under few obligations to comply with the officers questions without a few of his own. |

Corect me if I'm wrong but I believe that police in NY State can lawfully request that you identify yourself. But that's another subject.I didn't say Easy was breaking the law as I do not know what the law is in L.A. What I said was, that he refused to comply with the officer's request to identify himself, 3 seperate times. I also didn't say that this was wrong. What I said was it might be illegal in LA to refuse a police request to identify himself. I only suggested that he get legal advice before he decides to fight the issue. |

Come to think of it, that third one, if those were his exact words, could be construed as a refusal. His "No" was probably in response to "Do you want to escalate this?", but taken as being in response to "Are you refusing to show me your ID?"As for me personally, I probably would've started reaching for my ID as I ask why the officer wants to see it. I definitely would've been reaching for it before asking "why" the second time. |

Your point is one that I agree with and raised earlier. Maybe by not giving him my ID I was breaking the law. Who knows. I suspect that if that were really the case he would have cited me for that instead of unruly behavior. I don't quite know what to make of the fact that the deputies mentioned many times that not giving him my ID was the problem. Yet he hand wrote on my infraction that I was being cited for "unruly behavior." The cynic in me believes that in court this is what he will state was the real problem. I was in the way of passengers or was belligerent or some such. Any of that would be totally false.The ticket is for an infraction, not a misdemeanor. It'll be more like traffic court. In fact, it's basically a traffic ticket with my alleged infraction written where speeding or such would normally go. I wouldn't expect to need a lawyer. I'll tell what happened to the best of my recollection and if it turns out that I was wrong, well that's that. I'll pay my fine and be on my way. |
