I certainly cannot guarantee that Cuomo will be re-elected in November 2018. He might, as Trump would put it, murder someone on Fifth Avenue between now and then. IIRC - there was some legal action a some years ago with the SF Muni winning out (probably because with a 3,000 mile difference between cities there could be no mistaking the identity of the system where the bullet was being used).Not knowing if Nixon did not get a license agreement with the MTA to use the symbol (and I am assuming she didn't because I did not see the required legal MTA wording on the T-shirt or on her webpage) - I could just see the newspapers having a field day with this. The courts are pretty lenient when it comes to political speech and the use of trademarks. All the Nixon campaign (still sounds weird) has to prove is that its a legitimate political statement - which it is. ESPECIALLY since the MTA is a public service of the government. |
