Practically everything the government does will result in "victims" somewhere. If they close a block I regularly drive down so they can put in a public park, or if they add or increase tolls to fund public transit or whatever, I can't demand payback for time/money lost.Eventually I have to accept the fact that something is happening for the (apparent) good of the city in general at my expense. I have to hope that I will benefit from other government actions at others' expense to even things out. |

What comes to my mind here is the experement of making 61St Woodside a local only stop in both directions in the mid 1970s. The expresses would run from Junction Blvd. to QBP with the expresses highballing thru crowded Woodside platforms, leaning on their horn with several short toots & often going faster than they should.The locals folks & LIRR transfers screamed like hell. Then local congressman Ed Fowley threatened a class action suit against the MTA to right the wrong. Woodside & LIRR commuters rolled up their sleeves. To shorten the story, the MTA caved before any hearings commenced & Woodside was restored to express stop status. I don't know if that would qualify as a "precedent". I'll accept the legal minds opinion that post here to supply an answer. |

I had forgotten all about that.They did it because some scheduling nerd thought #7 expresses stopping at Woodside would foul the local/express merge west of 33/Rawson. That is a 5 minute lengthening of running time for Woodside, a 50% service slash, and also affecting LIRR transfers who did not do Hunterspoint, which became harder once Ronkonkoma electrification was done. But, there you go, degrade service, expect trouble. Since the MTA caved, no legal precedent was established. |
