Yes, and Forest Park is right there, a huge park. To use the ROW for that, with the amount of vegetation on it, would just be an invitation to muggers, rapists, and all sorts of criminal activity.

I don't know whether any trail has been lost completely, but I've heard several trails have restored rail service alongside an improved trail (i.e., share the r-o-w).

The trailists would just never allow it.

I agree ... BUT ... the railroads keep title in a rails-to-trails. If this is shown to be a legal fiction, then you have Catch-22. Landowners could then reclaim their easements and there could be no rail, no trail.

the railroads keep title in a rails-to-trails

The conservancy seems convinced that they are former rail lines. Only in the case of railbanking does the railroad retain anything.

Remember, in Queens there is practically a continuous east west park already. Parts of the row already border a park. If you want a park, level the row and make a ground level park. The High Line was an elevated row on a trestle, The Rockaway line only has trestles for the avenues it crosses, the rest is packed soil.

I'm looking at their site where it says "Because a railbanked corridor is not considered abandoned, it can be sold, leased or donated to a trail manager without reverting to adjacent landowners."

So does that mean that in cases where trails aren't railbanked, they've settled with local landowners? I know lots of owners don't seem to be happy with trails near their properties.

That's what I was thinking. Plus when that part of Queens develops (and it probably won't be that long) they'd be sorry they got rid of a main transit artery like that.

And that could certainly happen.

The casino portion is by far the largest on the east coast and the only one accessible by subway so easily.

Perhaps people in parts of Queens on the ROW who want to go to the Racino will put enough pressure to make it happen.

That is an excellent idea.

They can get rid of the poison ivy and at the same time build first a new ROW for the subway and then the park above that.

Not every railroad charter states that if the line is abandoned it "reverts to the adjoining property owners". I would probably say it's a safe bet that most don't.

I'm not certain that has to be in a railroad's charter. Easement agreements gave a railroad permission to use someone else's land as r-o-w in exchange for a promise of continuing service. If the service ended, so did the easement. That way a railroad couldn't end up selling someone else's land for a non-railroad purpose.

But all these charters, easements, and property ownership were not all made in the same ways. The railroad wasn't on an easement in many cases, they owned the land.

What if the Aqueduct Racino ends up becoming a major hit in the area?
I know service cant be restored overnight for that ROW, but maybe some sort of Subway expansion from the Queens Blvd Corridor or a branch of the LIRR mainline ending at Aqueduct?

For example, if even the Airport access couldn't get a revival of the Rockaway Branch up and running, a Casino certainly isn't either.

Yes, that's how I understood it when I read it and wrote my response (and asked my question back to you).

What about weekend G.O.s that suspend A/C service between Utica and Jay Street ? Granted it hasn't happened in a long time, but there is always a possibility.

That could be a legitimate concern. The shuttle busing or other mitigation plan would have to account for the normal ridership during that period. If business is booming at the casino and the A is running rush hour-like service on the weekends because of it, then NYCT will have to take that into account when they plan their GOs.
