Posted by kp5308 on Sun Mar 13 21:50:24 2011 First off, thanks for the suggestions on LIRR photo locations.Now on to the issue Alex spoke of earlier. We were wrapping up at Forest Hills: When two MTA cops asked us what we were doing. It pretty much was a tone of "I wish these LIRR guys would stop calling us about this picture stuff". A 5 minute conversation ensued, not heated, followed by me producing the NYPD photography letter. They told us that we should stop by the LIRR at NYP or Jamaica for a photo permit which is free. I knew this wasn't necessary but I chose a different tactic than confrontation. Now at that point I could not find the MTA photography paperwork. I took my last shot in front of the officers, informed them that our next stop for photos was Kew Gardens & we left. On the walk to Kew I found the MTA photography letter in my camera bag case I needed it. We shot at KG, Jamaica, & Freeport & even NYP & were not questioned for the rest of the day. |

We were called in either by an engineer or some stuck up snot (it is Forest Hills, after all) of a passenger.It saddens me we have people shitting their pants over a four eyes (me) and regular guy (kevin) with cameras. Some other person on the platform could have dialed 911 on his/her cell phone and said that there was a suspicious person on the platform taking photographs. The local precinct set cops out and the cops were probably told in training about the LIRR photo permit, whether accurate or not |

If you are correct you are correct some still can get worried, i did not. I had Cops run up on me in the Middle of Midtown while i was a messenger wearing slacks a dress shirt and tie and i got questioned... I "looked" like a robbery suspect, yup with all of that all on.Lucky for me Work ID,me carrying packages and a receipt with my last location helped. Everybody handles thier situtation different, some get nervous, some dont, some get kinda arrogant yes they do. |

One time, at Ludlow while I was doing some shooting, from the platform mind you, an MTA officer, who ended up being someone me and my brother (who is an MTA PD officer) knows, which in other words means he left after the usual friendly greetings, told me someone on Train 769 reported how I was on the right of way and fouling the tracks while shooting the trains, which EVERYONE who knows me knows could not ever be more false when I am off duty, especially fouling an active main line at the peak of the PM rush!! The officer knew that was BS, and again after the greetings, he left, pissed off because they called him to respond to a bullshit call being as he was about to get off duty at 7 PM, and the call came in at about 6:40 pm, and he didn't get to Ludlow until about 10 minutes to 7.Only because I have no need to start something I know would get me in trouble because I know how I would have reacted had I confronted that engineer, is the reason why I did not find out who was running that train and directly confront him. True they are doing their jobs, but again photography is LEGAL on our property, and the operating personnel and police need to get the knowledge in their heads before acting precipitously. Last week, I stopped and engineer and conductor on a Stamford local I was deadheading on from harassing a photographer at Cos Cob, because the fact is the guy was not trespassing, and photography it totally LEGAL, and the last thing I would want to see is a co-worker in my craft get in trouble for enforcing something that does not exist!! |

Dutch, when someone is doing nothing wrong, yes it is messed up to get harassed by officials over it!!I can take those cops out with me for 8 straight hours, and after the first hour, I can show them REAL troublemakers on that stretch of the LIRR within the first hour!! I am talking about graffiti vandals, basic trackwalking trespassers, kids playing chicken which I have seen almost already result in a death on the Main Line at Kew Gardens, which is a little way east of Forest Hills, and sadly even railfans who DO trespass right over at Whitepot Junction a mile or so west of Forest Hills. These guys are questioning people who are doing nothing wrong and doing it at a publicly accessible and LEGAL location. If they were out on the right of way, fine, then they deserve what they get. But at a station, c'mon man!!! Operating personnel and the officials needs to get the true knowledge before, as I stated previously, start going out and acting precipitously. And also as I stated, some of those engineers are some lying SOBs!! And I already had words with an engineer, who I am not going to say at which agency, who I heard admit would throw things when passing by at any photographer with a tripod set up on a platform, actions by him which is indeed a criminal act!!! |

Allow me to say, BBD, that there was indeed a notice issued by the MTA regarding the legality of photography back in 2006, and AFAIK, that order is still in effect and has not been superceded in any way, and it does state that photography on the MTA system is indeed legal, providing it is done in legal areas of the system, and not in restricted locations. |

It is just part of the on going terror hysteria, and of course people see camera, they think the worst, so true it might have necessarily been a train crew, however from my working experiences, I know engineers who will falsefully bang in a railfan just to break their balls!! It is a practice I do not like, and even recently I stopped a crew on a Stamford local from bugging a photographer out at Cos Cob. |
