1. the judge himself admitted poor jury instructions
2. the judge tossed the use of a gun during a felony conviction thus refusing to add the 2-10 specified for that conviction.
3. yes the jury bought the excuse.
4. in every Western I saw as a kid shooting someone in the back was portrayed as evil. I still hold that view.
