A reader of one of the photo rights blogs received the following response from MARTA regarding their photo policy:

Thank you for writing and sharing your comments and concerns with us. I appreciated you including the link and I personally enjoyed the author’s photographs of street life in Atlanta. I apologize that the author almost missed his flight and I wish that we had more detail, so that we could better investigate the incident.

Since the 9-11 attack and the subway bombings in Spain and the UK, all mass transit systems have been placed on high alert. As a result of the alert, our customers are asked to refrain from taking photos within the transit system. Persons wanting to take pictures within MARTA’s system, must first obtain authorization though MARTA Police Services. Those seen taking pictures without authorization, will be asked to cease immediately. Should the party choose not to adhere to this request, they will be asked to exit the transit system immediately.

It is truly unfortunate that we must enforce this policy, but MARTA considers the safety of our patrons and employees to be our top priority. I sincerely hope that you found this information helpful and that it better explains MARTA’s policy regarding taking photos within the system. Should you have any additional questions or concerns, please do not hesitate to contact us back. We will be more than happy to assist in any way possible. MARTA appreciates your input and the privilege to serve you.

It appears that their policy is in fact very restrictive. Time for the ACLU to sue!
