Its not that all cops will hassle you - I took some shots while cops were around and not a word was said (perhaps they were too busy staring at the model) - but the problem is so pervasive above the street as well as below the street. The NYPD is fully aware of the situation and the complaints yet they outright refuse to do anything to rein in the rogue cops. In spite of being put on notice by the NYCLU - NYPD has stated outright that they refuse to issue memos or training guidelines to officers regarding photographer's rights. That is what the pending lawsuit is trying to force them to do. Therefore it can be said that unofficially the NYPD is either tolerating or condoning the actions of those overly zealous cops. It is more an act of omission rather than of commission on the part of the brass.

The Mayor's Office of City of NY is also on notice - in the MOFTB public hearing on the proposed photo restrictions groups like PictureNY as well as the NYCLU and others repeatedly mentioned police harassment as a pervasive problem.
