I think those words could be used either way: as a legitimate and credible threat of physical harm, or as an expression designed to show contempt for another person that would not be reasonably interpreted as a physical threat. We have seen President Trump and Vice President Biden both "threatening" to beat up each other, but I don't think anyone seriously believed that either was actually making a threat of physical harm. This is why video showing the context would be especially helpful. And ultimately it is a jury question, the meaning of the words to be judged by twelve reasonable people from the community.Given what I have seen in the video, this man was rather agitated, animated, and without doubt crude--a great deal of emotion being exhibited--but also having controlled his physical posture. I am not certain how I would come down on the matter. |
